HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-01207 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A ROADWAY TRANSFER AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION ("DEPARTMENT"), TO ACCOMMODATE THE REBUILDING BY THE DEPARTMENT OF THE 1-395 CORRIDOR, FROM THE I-95/MIDTOWN INTERCHANGE TO THE WEST CHANNEL BRIDGE OF US 41/MAC ARTHUR CAUSEWAY, MIAMI, FLORIDA; FURTHER AUTHORIZING THE CITY MANAGER TO TAKE ALL ACTIONS NECESSARY TO ACCOMPLISH SAID TRANSFERS FROM THE CITY OF MIAMI STREET SYSTEM TO THE DEPARTMENT'S STATE HIGHWAY SYSTEM, AS STATED HEREIN. WHEREAS, the Florida Department of Transportation ("Department") is developing the preliminary design for a roadway project along 1-395, from 1-95 to the West channel bridge of the Mac Arthur Causeway, Miami, Florida; and WHEREAS, the project includes rebuilding the 1-395 corridor with new elevated ramps, updating the alignment, upgrading the roadway surface, and creating a new signature bridge with higher structures that will improve visual quality of the bridge; and WHEREAS, the new alignment and bridge structures will require the Department to acquire additional rights -of -way from private property owners and local governmental agencies; and WHEREAS, the transfer of several City of Miami ("City") roadways to the Department's State Highway System are necessary to accommodate the new bridges and rebuilding of the 1-395 corridor; and WHEREAS, pursuant to Resolution No. 14-0288, adopted July 24, 2014, the City Commission transferred several roadways to the Department for the proposed improvements; and WHEREAS, the Department has identified and requested the transfer to the Department's State Highway System portions of three additional roadways for the proposed improvements; and WHEREAS, the City agrees with the terms and conditions in the Roadway Transfer Agreement and the Perpetual Easements, and these transfers and easements are mutually agreed upon between the City and the Department; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, City of Miami Page 1 of 2 File Id: 14-01207 (Version: 1) Printed On: 12/3/2014 File Number: 14-01207 FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute the Roadway Transfer Agreement, in substantially the attached form, with the Department, to accommodate the rebuilding by the Department of the 1-395 corridor, from the I-95/Midtown Interchange to the West channel bridge of US 41/Mac Arthur Causeway, Miami, Florida. Section 3. The City Manager is further authorized{1} to take all actions necessary to accomplish said transfers from the City Street System to the Department's State Highway System. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS: i VICTORIA ENDEZ CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
