HomeMy WebLinkAboutR-14-0482City of Miami Legislation Resolution: R-14-0482 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-01228a Final Action Date: 12/11/2014 A RESOLUTION OF THE MIAMI CITY COMMISSION URGING GOVERNOR RICK SCOTTAND THE MEMBERS OF THE FLORIDA LEGISLATURE TO ENACT CHANGES TO FLORIDA STATUTE 556, REGULATING UTILITY PAINT MARKINGS ON THE PUBLIC RIGHT OF WAY TO ALLOW MUNICIPALITIES TO REGULATE THE DURATION AND REMOVAL OF SAID UTILITY PAINT MARKINGS ON THE PUBLIC RIGHT OF WAY; DIRECTING THAT THIS ISSUE BE ADDED TO THE CITY OF MIAMI'S 2015 LEGISLATIVE PRIORITIES; DIRECTING CITY CLERK TO TRANSMIT A CERTIFIED COPY OF THIS RESOLUTION TO THE OFFICIALS STATED HEREIN. WHEREAS, Florida Statute 556 regulates paint markings by utilities and excavators to mark where underground utilities are located to prevent accidents or service disruptions; and WHEREAS, Florida Statute 556 prohibits local governments from enacting regulations requiring that utilities use marking paint that fades in a timely fashion or requires removal of paint marking upon completion of work; and WHEREAS, the City of Miami ("City") expends funds every year for the replacement and repair of sidewalks, asphalt, and other portions of the public right of way; and WHEREAS, these nearly permanent paint markings create an unnecessary visual blight on the public right of way; and WHEREAS, this problem is particularly acute on rights of way where the City has expended considerable money for enhanced sidewalk design such as Biscayne Boulevard, Flagler Street, and the Performing Arts Center; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Resolution. Section 2. The Miami City Commission urges Governor Rick Scott and the members of the Florida Legislature to enact changes to Florida Statute 556, regulating utility paint markings on the public right of way to allow municipalities to regulate the duration and removal of said utility paint markings on the public right of way. Section 3. The Miami City Commission directs this issue to be added to the City's 2015 Legislative Priorities. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
