A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO REMOVE THE PLAY STREET DESIGNATION AUTHORIZED BY
RESOLUTION NO. R-12-0479, ADOPTED DECEMBER 13, 2012, FOR THE
PORTION OF NORTHEAST 60TH STREET, BOUNDED BY NORTHEAST 4TH
COURT TO THE EAST, EATON PARK TO THE NORTH, THE FLORIDA EAST
COAST RAILWAY TO THE WEST, AND THE PROPERTY LOCATED AT 5990
NORTHEAST 4TH COURT, MIAMI, FLORIDA, TO THE SOUTH; DIRECTING THE
CITY MANAGER TO TRANSFER ALL CONSTRUCTION,MAINTENANCE, AND
UPKEEP OBLIGATIONS OF SAID STREET TO THE CITY OF MIAMI DEPARTMENT
OF PUBLIC WORKS; FURTHER DIRECTING THE CITY CLERK TO TRANSMIT A
COPY OF THIS RESOLUTION TO THE DIRECTOR OF THE MIAMI-DADE COUNTY
PUBLIC WORKS/WASTE MANAGEMENT DEPARTMENT.
WHEREAS, the City Commission authorized the City Manager to designate a portion of Northeast
60th Street between Northeast 4th Court, Miami, Florida, and the Florida East Coast Railway, as a
"play street" by Resolution No. 12-0479, adopted December 13, 2012; and
WHEREAS, the City Manager has determined that the designated portion of Northeast 60th Street
no longer serves the purpose of a "play street," and would better provide for on -street parking for the
general public and the Palm Grove neighborhood, including the City of Miami's ("City") Eaton Park;
and
WHEREAS, the City Commission finds that it is in the best interest of the general welfare of the
City and its inhabitants to remove the "play street" designation from said portion of Northeast 60th
Street, Miami, Florida;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is authorized{1} to remove the designation of "play street,"
authorized by Resolution No. 12-0479, adopted December 13, 2012, for the portion of Northeast 60th
Street bounded by Northeast 4th Court to the East, Eaton Park to the North, the Florida East Coast
Railway to the West, and the property located at 5990 Northeast 4th Court, Miami, Florida, to the
South.
Section 3. The City Manager is directed to transfer all construction, maintenance, and upkeep
obligations of said street to the City Department of Public Works.
Section 4. The City Clerk is further directed to transmit a copy of this Resolution to the Director of
the Miami -Dade County Public Works/Waste Management Department.

Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by the City Commission.
