HomeMy WebLinkAboutR-14-0468City of Miami Legislation Resolution: R-14-0468 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-01160 Final Action Date: 12/11/2014 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE RESTRICTION OF VEHICULAR ACCESS TO THE WEST END OF NORTHWEST 4TH TERRACE, AT ITS EAST ENTRANCE INTO THE CITY OF MIAMI'S KINLOCH PARK, LOCATED APPROXIMATELY TWO HUNDRED THIRTY (230) FEET WEST OF ITS INTERSECTION WITH NORTHWEST 45TH AVENUE, MIAMI, FLORIDA, SUBJECT TO CERTAIN CONDITIONS AS MORE PARTICULARLY SET FORTH HEREIN; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE HEREIN DESIGNATED AGENCIES. WHEREAS, Northwest 4th Terrace, approximately two hundred thirty (230) feet West of Northwest 45th Avenue, currently "deadends" within the City of Miami's ("City") Kinloch Park ("Kinloch Park"); and WHEREAS, Kinloch Park's recreational center provides and accommodates for summer and winter camps, after school programs, and senior programs; and WHEREAS, in order to provide for the safety of children and seniors, and to address neighborhood concerns about unauthorized after hours vehicular access and parking within the park, it is necessary to secure and monitor vehicular parking; and WHEREAS, said restriction of vehicular access is being effectuated pursuant to Section 54 -16 of the Code of the City of Miami, Florida, as amended; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. It is hereby directed that vehicular access to the West end of Northwest 4th Terrace, at its East entrance into Kinloch Park, be prohibited at approximately two hundred thirty (230) feet West of its intersection with Northwest 45th Avenue, Miami, Florida, subject to the following conditions: a) Vehicular access shall be prohibited by a gate installed across the entire width of the Northwest 4th Terrace right-of-way, at the East entrance into Kinloch Park, at approximately two hundred thirty (230) feet West of its intersection with Northwest 45th Avenue; b) A minimum thirty six (36) inch wide gated pedestrian opening shall be provided in the sidewalk area; c) Said gates shall have a lock controlled by the City's Parks and Recreation Department; and d) Said restriction and gate operation shall be in conformance with park operation hours. The City Clerk is directed to transmit a copy of this Resolution to the Traffic and Transportation Section of the Miami -Dade County Public Works/Waste Management Department, and to the City's Departments of Police, General Services, Solid Waste, and Fire -Rescue. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
