A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT OF EASEMENT, IN
SUBSTANTIALLY THE ATTACHED FORM, GRANTING TO THE FLORIDA
DEPARTMENT OF TRANSPORTATION A PERPETUAL, NON-EXCLUSIVE
EASEMENT OF APPROXIMATELY SIX HUNDRED FIFTY SIX (656) SQUARE FEET
OF CITY OF MIAMI OWNED PROPERTY LOCATED AT 2200 WEST FLAGLER
STREET, MIAMI, FLORIDA, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT
"A," ATTACHED AND INCORPORATED, TO CONSTRUCT AND MAINTAIN A
SIDEWALK TO COMPLY WITH REQUIREMENTS OF THE AMERICANS WITH
DISABILITIES ACT, AND TO INSTALL AND MAINTAIN A SIGNALIZATION
CONTROL PANEL IN, OVER, UNDER, UPON, AND THROUGH SAID PROPERTY.
WHEREAS, the Florida Department of Transportation ("FDOT") has requested a Grant of
Easement of approximately six hundred fifty six (656) square feet of City of Miami ("City") owned
property located at 2200 West Flagler Street, Miami, Florida ("Property"), more particularly described
in Exhibit "A," attached and incorporated; and
WHEREAS, this easement will be used for an FDOT Road Improvement Project; and
WHEREAS, FDOT has prepared an application to execute and deliver a perpetual easement,
in favor of FDOT, for the purpose of constructing and maintaining a sidewalk to comply with
requirements of the Americans with Disabilities Act ("ADA"), and for the installation and maintenance
of a signalization control panel; and
WHEREAS, the easement shall further contain a reverter provision that states if the easement
is abandoned, discontinued, or used for any other purpose, the Property subject to the easement
shall revert back to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute a Grant of Easement, in substantially
the attached form, granting to FDOT a perpetual, non-exclusive easement of approximately six
hundred fifty six (656) square feet of City owned Property, as more particularly described in Exhibit
"A," attached and incorporated, to construct and maintain a sidewalk to comply with requirements of
the ADA, and to install and maintain a signalization control panel in, over, under, upon, and through
said Property.

Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including, but not limited, to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
