HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-01139 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ESTABLISHING A NEW SPECIAL REVENUE PROJECT ENTITLED: "PEDESTRIAN AND BICYCLE SAFETY ENFORCEMENT CAMPAIGN"; AUTHORIZING THE CITY MANAGER TO EXECUTE A LETTER OF AGREEMENT AND CONTRACT WITH THE UNIVERSITY OF SOUTH FLORIDA, IN SUBSTANTIALLY THE ATTACHED FORM, FOR REIMBURSING THE CITY OF MIAMI FOR OVERTIME EXPENSES, IN AN AMOUNT NOT TO EXCEED $73,699.20; FURTHER AUTHORIZING THE CITY MANAGER TO DESIGNATE THE CHIEF OF POLICE TO EXECUTE ANY OTHER NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, IN ORDER TO IMPLEMENT THE ACCEPTANCE OF SAID REIMBURSEMENT FUNDS. WHEREAS, the Florida Department of Transportation ("FDOT"), through a Task Work Order with the University of South Florida ("USF"), utilize local law enforcement support to educate and enforce safe pedestrian, bicyclist, and driver behaviors in high priority counties throughout Florida; and WHEREAS, this campaign is a component of Florida's Bicycle/Pedestrian Focuses Initiative Communication and High Visibility Enforcement Implementation under the direction of FDOT and USF; and WHEREAS, the objective of this effort is to reduce traffic crashes and fatalities involving pedestrians and bicyclists, through the use of selected traffic enforcement and education details; and WHEREAS, the Letter of Agreement and Contract presented by FDOT and USF is intended to utilize the support of the City of Miami ("City") Police Department ("Department"), by allotting funds to educate and enhance a comprehensive safety campaign that promotes safe pedestrian, bicyclist, and driver behaviors within high priority intersections throughout the City; and WHEREAS, this high visibility enforcement program is managed through contracts, not grants, and FDOT has allotted program funds in an amount not to exceed $73,699.20, to fund City police officer overtime pay for hours spent conducting on -street enforcement operations that promote pedestrian and bicycle safety or making on -street contacts with the public to deliver program safety messages; and WHEREAS, the Department's Traffic Enforcement Unit has prepared a program plan for purposes of conducting said enforcement and education activities; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 2. The following new Special Revenue Project is established and resources are appropriated as described below: FUND TITLE: Pedestrian and Bicycle Safety Enforcement Campaign RESOURCES: University of South Florida and the Florida Department $73,699.20 of Transportation APPROPRIATIONS: Reimbursement of overtime expenses $73,699.20 Section 3. The City Manager is authorized{1} to execute a Letter of Agreement and Contract with USF, in substantially the attached form, for reimbursing the City for overtime expenses associated with said campaign. Section 4. The City Manager is further authorized{1} to designate the Chief of Police to execute the necessary documents, in a form acceptable to the City Attorney, in order to implement the acceptance of said reimbursement funds. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPOVED AS TO FORM AND CORRECTNESS: VICt ORIA ME: DEZ . CITY ATTO RN EY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
