Director Chief City Manager Page 1 of 2 Background Information The City holds a 12 foot wide permanent public utility easement upon the southwest side of the property located at 498 SW 27th Road. The owner of the property desires to terminate a portion of the easement and reduce the easement to a 7 foot wide non-exclusive utility easement upon the southwest side of the property in order to accommodate private improvements on the property. To compensate for the reduced width of the existing easement and to provide improved access to existing utilities, the owner of the contiguous property would grant a 5 foot wide perpetual utility easement to the City upon the northeast side of the property located at 463 SW 28th Road. Acceptance of the termination and modification of the existing easement and the new perpetual easement will result in the shifting of the alignment of the current easement 5 feet to the southwest. Existing utilities located within the current easement would not be affected by this modification and all owners of the existing utilities have expressed no objection to the shift in the alignment of the easement.
