Purpose of Item:
A Resolution to accept a Title VI/Nondiscrimination Program Plan. The City is required by Federal and State law
to adopt a nondiscrimination policy. This resolution accepts the Title VI Policy, as reviewed by the City Attorney.

The City is required to establish' a formal Title VI/Non-Discrimination policy to formalize procedures for
reporting, investigating, and responding to acts of discrimination. The trolley program was initiated with state
funds for initial acquisition of trolley vehicles and transit's half cent surtax monies for the operation and
maintenance cost. However, on December 2012 the City accepted 19 trolleys acquired through the American
Recovery and Reinvestment Act of 2009 (ARRA) federal funds, as a sub -recipient through Miami -Dade Transit.
As such, the City now needs to comply with certain federal provisions included the Interlocal Agreement
approved October 27, 2011 by the City Commission with Miami -Dade County.
In 2013, a Title VI complaint was filed with the Federal Transit Administration (FTA) against the City of Miami
(City) and the City of Coral Gables. The complaint alleged discrimination against minority populations by
permitting a trolley maintenance facility within a minority community without adequate public input. The
referenced facility is located in West Grove along SW 37t' Avenue (also known as Douglas Road) and was
constructed for the City of Coral Gables Trolley system.
The City has worked closely with county, state, and federal representatives to develop the attached Title VI/Non-
Discrimination program. Through this process, the City has received feedback that ensures the program complies
with Federal, State, and County standards. The program provides City staff with guidance in how to file,
investigate and follow-up on Title VI/Non-Discrimination complaints.
Through this resolution, the Commission is requested to formally adopt the Title VI/Non-Discrimination Program
for the City of Miami.
