A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A COVENANT RUNNING
WITH THE LAND IN LIEU OF UNITY OF TITLE, IN SUBSTANTIALLY THE
ATTACHED FORM, WITH MIAMI-DADE COUNTY, FOR THE HADLEY PARK
YOUTH CENTER PROJECT, PROJECT NOS. B-35883AAND B-35883AS.
Vb iEREAS, the City of Miami ("City") is the owner of certain real property located at Folio Number
No. 01 3123-016-0020, Miami, Florida, known as the Hadley Park Youth Center ("Property"), which is
legally c. scribed in F•-'-,.:hit "A," attached and incorporated; and
WHERE,- , ine Miami -Dade County Water and Sewer Department ("WASD") is the owner and
operator of the sanitary sewer and water mains ("Facilities") servicing the Property; and
WHEREAS, the City intends to operate and maintain a private sanitary sewer system and other
associated facilities, from which the property shall be connected to the sanitary sewer system owned
and operated by Miami -Dade County ("County"); and
WHEREAS, WASD requires that the City enter into a Covenant Agreement ("Agreement") to
allocate the responsibility of operating and maintaining the private sanitary sewer system to the City;
and
WHEREAS, the Agreement also acknowledges that any future transfer or development of the
Property by the City will not violate the zoning code of the municipality wherein the property is located
when it is so developed;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute a Covenant Running with the Land in Lieu
of Unity of Title with the County, in substantially the attached form, for the Hadley Park Youth Center
Project, Project Nos. B-35883A and B-35883AS.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by the City Commission.
