HomeMy WebLinkAboutResolutionCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-01212 Final Action Date: 11/20/2014 A RESOLUTION OF THE MIAMI CITY COMMISSION APPROVING THE HONORING OF PABLO RAUL ALARCON WITH THE INSTALLATION OF A NAME PLAQUE ON THE CALLE OCHO WALK OF FAME NEAR THE INTERSECTION OF SOUTHWEST 8TH STREET AND SOUTHWEST 15TH AVENUE, MIAMI, FLORIDA; DIRECTING THE CITY MANAGER TO NEGOTIATE AN AGREEMENT WITH THE CALLE OCHO CHAMBER OF COMMERCE, USA ("CHAMBER"), FOR THE INSTALLATION, MAINTENANCE, AND INDEMNIFICATION OF THE CITY OF MIAMI ("CITY") RELATIVE TO THE NAME PLAQUES ON THE CALLE OCHO WALK OF FAME, AND FURTHER SUBJECT TO BRING SAID AGREEMENT TO THE CITY COMMISSION FOR FINAL REVIEW, ACCEPTANCE, AND APPROVAL; FURTHER REQUIRING THE REMOVAL OF SAID NAME PLAQUE SHOULD THE CHAMBER AND THE CITY FAIL TO FORMALIZE AN AGREEMENT. WHEREAS, the City Commission adopted Resolution No. 89-708, on July 27, 1989, which approved, in principal, the inlaying of plaques in the sidewalk area along Southwest 8th Street, between Southwest 12th Avenue and Southwest 17th Avenue, Miami, Florida, to honor international artists, sports figures, and outstanding individuals of the Latin Community, with the implementation of same being subject to the approval of the administration of the City of Miami ("City"); and WHEREAS, the City Administration has issued permits for the installation of plaques honoring certain individuals of the Latin Community, leading to their successful installation; and WHEREAS, the Calle Ocho Chamber of Commerce, USA ("Chamber"), a not -for -profit corporation, has volunteered to install a plaque honoring the late Pablo Raul Alarcon, founder of the Spanish Broadcasting Systems; and WHEREAS, the Chamber has proffered to negotiate and enter into an Agreement with the City for the installation, maintenance, and indemnification of the name plaques on the Calle Ocho Walk of Fame; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. Pablo Raul Alarcon, founder of the Spanish Broadcasting Systems, is hereby approved to be honored with the installation of a name plaque on the Calle Ocho Walk of Fame, near City of Miami Page 1 of 2 File Id: 14-01212 (Version: 1) Printed On: 1/16/2018 File Number: 14-01212 the intersection of Southwest 8th Street and Southwest 15th Avenue, Miami, Florida. The installation (including plaque measurements and materials) and maintenance of this commemorative plaque shall comply with the applicable laws, codes, and standards of the Miami -Dade County and City of Miami Public Works Manual(s), as applicable. Section 3. The City Manager is directed to negotiate an Agreement with the Chamber, for the installation, maintenance, and indemnification of the name plaques on the Calle Ocho Walk of Fame, and to bring said Agreement to the City Commission for final review, acceptance, and approval within ninety (90) days of the adoption of this Resolution. Section 4. Should the Chamber and the City fail to formalize said Agreement within ninety (90) days of the adoption of this Resolution, said name plaque shall be removed and the sidewalk area promptly restored to the satisfaction of the City Public Works Director, at the sole cost of the Chamber. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} APPROVED AS TO LEGAL FORM AND CORRECTNESS: VICTORIA MENDEZ CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
