Hannon DATE : September 19, 2014 FILE : City Clerk FROM : Daniel Rotenberg, Director Department of Public Facilities SUBJECT: Fire Station for The Blue on Coral Way 3170 SW 22 Street Street, Miami, Florida REFERENCES: ENCLOSURES: Enclosed you will find an ad for notice of a public hearing to be held by the City Commission on September 29, 2014 for the purpose of authorizing the City Manager to negotiate and execute a Development Management Agreement ("Agreement"), between the City of Miami ("City") and 3170 Holdings, LLC ("Developer") to lease space to the City for a fire station. Please place the ad in accordance with public hearing requirements of the City Commission. Thank you for your assistance in this matter. Enclosure CITY OF MIAMI, FLORIDA NOTICE OF PUBLIC HEARING A public hearing will be held by the City Commission of the City of Miami, Florida on September 29, 2014, at 9:00 A.M. at City Hall, located at 3500 Pan American Drive, Miami, Florida, for the purpose of granting the following: AN ORDINANCE OF THE MIAMI CITY COMMISSION, AUTHORIZING THE CITY MANAGER TO EXECUTE A DEVELOPMENT AGREEMENT ("AGREEMENT") BETWEEN THE CITY OF MIAMI ("CITY") AND 3170 HOLDINGS, LLC, A FOR PROFIT CORPORATION ("DEVELOPER"), FOR A PRIVATELY -OWNED PROPERTY LOCATED ON APPROXIMATELY 1.3 ACRES AT 3170 SOUTHWEST 22 STREET, MIAMI, FLORIDA, AGREEING TO RENEW AND EXTEND THE PREVIOUSLY APPROVED MAJOR USE SPECIAL PERMIT ("MUSP") FOR "THE BLUE ON CORAL WAY" ("PROJECT") UNDER THE "PILOT PROGRAM FOR DISTRESSED DEVELOPMENT SITES," AUTHORIZING THE FOLLOWING USES: 190 MULTI -FAMILY RESIDENTIAL UNITS, 4,135 SQ FT RETAIL, 11,000 SQ FT FIRE STATION, 4,100 SQ FT OPEN RECREATIONAL SPACE, APPROXIMATELY 331 SPACE PARKING GARAGE; AND THE DEVELOPER HAS AGREED TO DEVELOP AND LEASE TO THE CITY APPROXIMATELY 11,000 SQUARE FEET WITHIN THE PROJECT FOR THE PURPOSE OF ERECTING A FIRE STATION, FOR A TERM OF ONE HUNDRED (100) YEARS WITH TWO (2) NINETY NINE (99) YEAR EXTENSIONS AT A COST OF $10.00 PER YEAR, A ONE TIME CONTRIBUTION BY THE CITY TO THE DEVELOPER OF $1,000,000.00, AND THE WAIVING OF CERTAIN IMPACT FEES FOR THE PROJECT; FURTHER AUTHORIZING THE CITY MANAGER TO MAKE NON -SUBSTANTIVE AMENDMENTS TO SUCH AGREEMENT, AS NEEDED, WITH TERMS AND CONDITIONS MORE PARTICULARLY SET FORTH IN THE AGREEMENT, SUBJECT TO APPROVAL BY THE CITY ATTORNEY. All interested persons are invited to appear and may be heard concerning these items. Should any person desire to appeal any decision of the City Commission with respect to any matter considered at this hearing, that person shall ensure that a verbatim record of the proceedings is made, including all testimony and evidence upon any appeal may be based (F.S. 286.0105).
