Article 5, Section 5.3.1 Building Disposition, establishes the required minimum setbacks 2. The subject application proposes the legalization of an existing addition to a two- family residence, which are units 1 and 2. 3. Unit 2 represents the existing addition that requires legalization. The unit provides a rear setback of 3 feet 11 inches, where 20 feet 0 inches is required. The unit encroaches into the rear setback 16 feet 1 inch, 3. The addition was built without the benefit of a building permit, creating a self- imposed hardship and should therefore not be considered a valid justification for any encroachment. 4. It is found that the granting of the Variance will not be consistent with the applicable criteria as set forth in Article 4, Table 12 and Article 7, Section 7.1.2,7 (b). Attached are Miami Dade County property appraisal records for neighboring lots within the block that indicate this fact. At the time of purchase Block 2 had two designation T3-0 and T3-L, the lots west of T3-O are designated T3-L, see attached page 50 of Miami 21 Zoning map. Mr. Ortiz submitted application for a land use amendment and rezoning that during its process the planning department saw it fit to request the change for the entire block 2 as a City Initiated Request to T3-0, this was granted. As soon as Mr. Ortiz took possession he pulled permits for repairs to the property when an inspector advised him that the home is designated single family. The next thing that was brought to Mr. Ortiz attention was that the construction was completed without a permit and its rear setback did not meet the City of Miami zoning code. Changing the land use and then the rezoning was to occur first prior to being able to request the legalization of the existing construction completed without a permit. Now after the city approval Mr. Ortiz is able to request the needed rear setback variance 25' required 3.90'ft provided. This would seem to be an excessive request but because of the neighboring home within block 2 it would be similar in appearance than those already in existence. Most of these setbacks where established in 1925, as records indicate. The property located to the east was one of those established in 1925 with similar rear setback. The property to the west has a similar rear setback but we believe this was also completed without a permit many years ago by its appearance. We feel that the approval of this setback will not be any difference in appearance than others within the block that have a similar rear setback. The approval of the variance will also permit the owner to legalize the rear construction in compliance with proper building codes.
