for a Special Certificate of
Appropriateness for new construction of a
mixed-use building at 4510 Northeast 2nd
Avenue and 191 Northeast 45th Street,
within the Buena Vista East Historic
District.

MS. SCHMITT: Good afternoon. This
is an application of a Certificate of
Appropriateness for the construction of a
new mixed-use project. The addresses are
191 Northeast 45th Street, 4510 Northeast
2nd Avenue.
This item is related to HEPB
Resolution 2014-022, a resolution
approving with conditions an application
for the demolition of multiple structures
at 4510 Northeast 2nd Avenue and 191
Northeast 45th Street.
The Buena Vista East Historic
District designation report states the
following:
"The neighborhood has retained its
distinct character, with the majority of
postwar buildings being small,
single-family residences designed to
conform with, rather than detract from the
historic and cohesive architectural
fabric. The few intrusions within the
district are restricted to small-scale
apartment buildings and modest
single-family dwellings."

It also states, "Although the
majority of the buildings in the Buena
Vista East Historic District have been
altered, the original massing of most
houses has remained virtually unchanged.
Typical alterations consist of the
installation of contemporary windows,
doors, roofing and awnings or the
enclosure of porches and additions of
garages or porte cocheres. However,
despite these alterations, the integrity
of the historic fabric and its character
is still preserved."
When reviewing proposals for new
construction, criteria such as design,
massing, materials, fenestration and other
important factors must be carefully
considered. The Preservation Office
believes that development of these parcels
must be done using the designation
report's concern for appropriate scale,
compatible materials and other design
issues that will impact the character of
the district.

construction that involves the demolition
of buildings under the purview of the HEP
Board, the following question is asked of
the proposed plans:
Whether architectural plans have been
presented to the Board for the reuse of
the property, if the proposed demolition
were to be carried out, and the
appropriateness of said plans to the
character of the historic site or
district, if applicable.
The applicant has provided plans for
the reuse of the property, should the
demolition be carried out.
The Preservation Office first had
contact with this applicant in March, when
the owner came in to pull a demolition
permit. Staff explained the process for
applying for a demolition permit for
structures located within the historic
district.
A meeting was held with the applicant
and his representatives on April 7, 2014,
at which time staff expressed concern for
the scale and compatibility of the

proposed design within the Buena Vista
East Historic District. These plans were
reviewed by the HEP Board at the May 6,
2014 meeting, and the Board moved that the
item be continued so that the applicant
could have more time to work with staff
and other stakeholders to make the
proposed design more appropriate for its
context.
Staff met with the applicant and his
team again on May 9, 2014, to reconsider
revisions to the proposed design. Issues
of scale, height and materials were all
discussed, keeping in mind the comments
made at the May 6th HEP Board meeting.
It is staff's understanding that the
applicant and his team also sought input
from members of the community.
Staff finds the revised proposal to
be a significant improvement over the
previous application. The height of the
building has been reduced and the trellis
feature has been reconfigured, resulting
in a noticeable change to the perceived
scale. The residential and commercial

uses are more successfully articulated by
enclosing the terraces in a patterned
aluminum screen and by tucking the spiral
staircases behind the vertical louvered
screens. This restores a sense of privacy
to the residential spaces facing Northeast
2nd Avenue, which is more typical of
older, mixed-use properties. The changes
to some of the finishes and colors give
the overall project a warmer feel, an
improvement from the previous proposal,
which staff found to be too cold and
metallic. These changes help the design
relate more successfully to the historic
district's predominantly residential
character.
The Preservation Office, in
accordance with the Secretary of
Interior's Standards and the City of Miami
Design Guidelines for Historic Resources
recommends that the application for a
Special Certificate of Appropriateness for
the construction of new, mixed-use
project, located within the Buena Vista
East Historic District be approved with

conditions.
And the conditions are as follows:
No COA will be issued until the
applicant is in compliance with Condition
2 of HEPB Resolution 2014-022, which
states that the "Applicant will secure
each structure (currently existing on
site) in compliance with City code
regarding vacant properties and will make
reasonable efforts to improve the
appearance of the site.
Condition 2. Details of signage --
of the signage package will return to the
Preservation Office for staff review.
Condition 3. A sample of the
proposed aluminum screen shall be
presented to the Preservation Office staff
prior to receiving final approval.
And Condition 4, the glazing shall be
clear.

comprehensive report on the changes to our
p r o j e c t .
I would like to reiterate that the
application is now been going through the
process for over three months. In
addition to the meetings that Megan
referenced, we did have a meeting -- my
client rather, had a meeting, together
with the architect Kobi Karp that's with
us today, as are the owners of the
property, Harry Benitah and Mark Suraqui,
who are here, and they have met with some
members of the Buena Vista historic
district on May 12, at Kobi Karp's office,
and took into consideration many of their
comments.
What you have I think is essentially
a very softened architectural statement,
one that is more in keeping with the type
of buildings and the scale of buildings
that predominate 2nd Avenue in this area.
And I think that the changes are really
significant, particularly the upper level
trellis, the setback, it's barely
appreciable now from the sidewalk. The

color changes are very much earth tones
now, so that you really don't have that
sort of more urban feel. It's a little
bit more almost suburban in character.
And overall the project I think really
works. It continues to provide a
significant amount of parking for this
area, that the area desperately needs. A
problem that pervades all of our
commercial corridors outside of downtown
is the lack of parking.
Many of these buildings are
nonconforming. The ones that we're trying
to emulate are nonconforming. This one
has the benefit of looking like that, but
also providing the required amount of
parking so that you don't have the
spillover of parking into the residential
neighborhoods, which is always a problem
and source of complaint from neighbors.
So with that said, I'd like to ask
Kobi to come up and go through some of the
changes in more detail with you.

the project, 2915 Biscayne Boulevard.
And based on our last meeting also,
what I wanted, based on staff comments,
which you're in agreement with, I wanted
to share with you.

I just wanted to share this with you.
Maybe you can pass this around. But,
basically it is a sample material board,
which on it is the aluminum sample that
we're looking for the trellis work to do.
The comments that we had last time,
and we also met with the neighbors at our
offices, they were very, very kind to come
over.
And what we did, is we did reduce the
height of the building. We pushed back
the trellis work on top. And we brought
back this lattice work, which is
reminiscent of the material that is
onsite, yes, which is reminiscent of the
pre -cast, which is onsite in the
neighborhood.

We took the stone also. And if you

can see, we have stoney materials, which
3
are more in context with the residential
4
neighborhood nearby.

And we put these two images right
6
next to each other. We reduced the height
7
of the commercial. We reduced the height
8
of the building. I think we're down to
9
36 feet now.

And, also, further, what we were
11
asked in our meeting was, if we can find a
12
way to enclose the staircases, which we

did. And those were the changes.

Also, we introduced -- as you can
15
see, on the bottom, right here, we
16
introduced the bulkhead with stone
17
material.

And we feel that we have listened to
19
the comments that you had before. And
20
hopefully this meets your criteria. And
21
if there's any comments or suggestions,

name is Wendy Stephan. I live at 101
6
Northeast 43rd Street.
7
And I met with the two past -- well,
8
the current president of the Buena Vista
9
East Historic Neighborhood Association,
10
Schiller Jerome, and the past president,
11
Rich Raimann, and myself. We all did meet
12
with the applicant and Mr. Karp on May
13
12th. And we issued our response on the
14
19th.
15
At -the time of the meeting, we were
16
-- when we sat down and we were working
17
with the original plans, we were told that
18
they were willing to make tweaks to the
19
original design. We had hoped, after the
20
initial meeting, that there would be sort
21
of a broader reworking of the proposal,
22
because we felt that the Board was pretty
23
-- was looking for something a little bit
24
more dramatic in terms of our review. And
25
we were also hoping for a more broad

change. So we made it clear that we were
concerned that the minor tweaks, sort of
around the edges, might not be enough
really to make it an appropriate project.
That being said, we offered specific
commentary about the elements of the
original proposal that were most
concerning to us, which were the height,
you know, too much glass, the materials
that we felt were inappropriate. We were
asked to make alternate suggestions. That
being said, we're not architects, so we're
not really qualified to do a lot of that,
but certainly we commented on some of the
concerns we had.
A lot of these concerns overlapped
with the concerns expressed by the
historic preservation officer, but we did
-- we do remain very concerned about the
45th Street entrance. The existing -- the
existing lots only have a single curb cut,
and that's only on the property that faces
Northeast 2nd Avenue.
The corner property, the 191

multiunit building, had no curb cut, no
2
driveway, so it does represent a change
3
from the existing entrance. We do have a
4
concern that it does -- it will pull more
5
traffic into the neighborhood, so that is
6
a concern that we continue to have.
7
We're also concerned about the
8
setback. There is no 10 -foot setback at
9
the front, which is required by Miami 21,
10
and that still has not really been
11
addressed at all.
12
So, overall, we still don't feel that
•
13
we can support the revised proposal. For
14
those reasons, we feel that -- we
15
certainly see that some of the changes
16
that we have been -- that we mentioned
17
have been made, but, again, we do feel
18
that it was essentially small changes to
19
an inappropriate project. So that is our
20
position.

We also want the Board to be aware
22
that even though you all raised and we've
23
raised concerns about the condition of the
24
property, not a single thing was done in
25
the last month to secure the property or

to clean it in any way. So that's really
disappointing that we had to look at it
for another month.
Even as we go through this process,
you know, the only thing that happened was
that the scrap metal was stolen off the
property. So wherever those thieves are,
thank you, but, I mean, that's
disappointing.

just have a couple of words in response to
that?
CHAIRMAN HOPPER: Sure.

I just want to state that with
respect to whether or not the changes were
broad, I think that Wendy mentioned three
different topics: The height, the glass
and the style of the building. All three

of those elements have been changed. The
reduction from 40 to 36 feet is
significant, given that this is a
relatively low intensity transect, T4; the
amount of glass has been reduced and
designed in a different way to be less
apparent; the style of the building and
the colors have changed. I think that the
approach is a rather broad brush change.
With respect to the entrance on 45th
Street, this is a requirement of Miami 21.
This is not something that is negotiable
or something that we can address. It is
required that when you have two frontages,
a principal front and a secondary front,
that the access to the property be from
the secondary front. The purpose of this
is to encourage additional and to not
interrupt existing pedestrian activity on
the avenue. And that's exactly what we're
trying to do through this project.
The last issue mentioned is whether
or not this entrance will draw additional
traffic into the neighborhood. I would
submit to the Board that this entrance is

only a few feet away from the avenue.
And, in fact, what it will do is reduce
vehicular impacts in the neighborhood by
allowing cars to enter into the
underground parking area immediately,
instead of turning into the residential
neighborhood and looking for on -street
parking in front of people's homes.
People will know how to get to this site.
They won't be driving around City blocks
searching for parking. And the
consolidation of one entrance into -- of
two separate entrances for two different
lots into one location that's readily
accessible off the avenue is preferable
method of access.

required is 10, and we have basically

matched the existing property immediately

adjacent to us and held it back at zero.

the reason for that is that Miami 21 has a
16
required setback, but it also contains a
17
provision that allows a developer to
18
establish the predominant setback in a
19
neighborhood. So given that other
20
buildings along this block and in this
21
area are developed at this zero setback,
22
that's the way that we developed this
23
project. And that's not a change. That
24
was something that was in the initial plan

that was submitted to the Board and that

you all reviewed the first time.

BOARD MEMBER LEWIS: The fact that

you're matching the frontage of property
4
to the north certainly makes sense to me,
5
but the neighbors or the neighborhood
6
association is not keen on that. And I
7
wondered whether --

MR. KARP: Let me just --

BOARD MEMBER LEWIS: What explanation

had you given them.

MR. KARP: There's two. There's two.
12
Number 1 is, we meet the setbacks on 45th

and everywhere else. And also you can see
14
in the design, specifically on page A-2,
15
what we did is we maximized the setback to
16
the west. And so by being able to pull
17
the building, if you will, more towards
18
2nd to match the line of the neighboring
19
buildings, we were able to also provide
20
substantially more setback on our west
21
side, which is also kind of nice, because
22
the west rear, if you will, where we do
23
have a two-story apartment building right
24
immediately adjacent to us, the required
25
setback, if the rear or west is five feet,
is

and we were able to provide 20 feet.

And, again, we did that, and we felt
3
that by the improvements that are coming
4
to the public right-of-way -- and we met
5
with the neighbors and the neighbors -- we
6
went through the plans in detail, and we
7
discussed this. And obviously what would
8
happen here is on Northeast 2nd, is that
9
you would have an opportunity to basically
10
match the commercial line, which exists
11
not only to the north adjacent property,
12
but also when you cross the street and you
13
go further north to the next block, you
14
have the same condition. So that creates
15
more of a pedestrian friendly, sort of an
16
ambiance along the east elevation, which
17
is Northeast 2nd Avenue.
18
Which is also when we met with the
19
neighbors and when we were here in front
20
of you, they asked us to lower the
21
commercial to match, that seemed to all
22
work pretty good. So those were the two
23
factors on the setback.

me that you're looking for a waiver with

regard to the lot coverage. And if you
were not to ask for that, I don't think
you would even acquire adequate frontage
multiplied by 10 feet. I think you'd
still be over the 10% waiver that you're
seeking.
So, again, under just under the
spirit of communication, that makes sense
to me.
What did you take away from your
meeting with the neighbors, when they
continued to object to the fact that there
is no front setback on 2nd Avenue?
MR. KARP: When we met in my office
with Wendy and the other two gentlemen,
and they came through, they felt that, you
know, the bulkhead and matching the
facades was more important than to provide
that setback. I mean, that is really what
we got from it.
We also feel that there's a broad
sidewalk coming on 2nd with the
improvements. So there's an opportunity
for the public right-of-way to be treated
properly. So we felt pushing it in 5

feet, or 7 feet or 10 feet is just not
something that would, if you will, benefit
the project, so we kept it where it is at
that location.
We did, though, introduce the
bulkhead. We did, though, reduce the
height. We did, though, if you remember
the signage, we moved it down. Everything
else was talked about was implemented.
And I personally feel, as the
architect for the project, that it's
important to hold that line. I think it's
important to hold a commercial line as it
exists right now and to the adjacent
properties.

at these two renderings, I see far more
tweak than I do response to what I
believe, at least I said, at the last
review.
And what I was looking for was for
someone to, in fact, look at the character
of the buildings in the historic
neighborhood, and to begin to take to this
facade and take to this building some of
that character, okay?
I mean, the immediate thing that you
could say is that there's probably no
building in the historic -- in at least
that neighborhood context that has as much
glass as this building has, okay? The
majority of those facades tend to not be
glass. They tend to be boxes with
windows. I know you've said that you've
reduced the amount of glass. I'm having
trouble seeing that between the two
renderings. And maybe someone could tell
me that I'm wrong.
I'm also kind of questioning, we
heard at the last review, that in a
traffic and parking study, that 45th

perplexed about, okay, was that we've

heard that there is now a broad pedestrian

sidewalk proposed for Northeast 2nd

Avenue. And if I'm looking at your plan,

A-2.00, I see a very minimal sidewalk.

And I'm going to say it's maybe five feet.

That, by definition, is not a broad

pedestrian sidewalk making a friendly -- a

pedestrian -friendly road. Am I misreading

a plan? Is that a broad sidewalk?

sidewalk that is there. And according to
our discussions, there is a proposed
improvement on Northeast 2nd, which is
coming up.
And, again, just to tie back to some
of the images that we had in the last
presentation, that we had the photos of
the neighboring buildings -- and if you
want me to, I'll be more than happy to go
through the metal work and the design.
And, you know, many of the residences in
the neighborhood, which have the high
ceilings, just simply due to the reason
that there was cross -ventilation in those
structures and so that the hot air, up in
the air, would flow through the space. So
there are a lot of examples of that.
MR. FERNANDEZ: And if I may add to,
Kobi, to that, Mr. Marston, it's my
understanding that the 10 -foot sidewalk is

improvements already has the project
underway, but that 10 -foot sidewalk takes
place within the existing right-of-way
that the City owns. So the sidewalk, when
it is expanded, will be expanded to the
east from the existing sidewalk into what
is the swale area. As we all know, that
street is in terrible condition all the
way north out of the Design District. I
mean, it's probably one of the worst
streets in the City of Miami to drive. So
those improvements will happen. And, in
fact, I think they justify and bolster the
front setback that we're providing.
With respect to your question
concerning the direction of the traffic,
we've spoken to public works. I'm aware
of no such plan to redirect streets. I
know that there are many neighborhoods in
the City of Miami that would appreciate
that kind of change. It's been discussed
as a remedy citywide to address traffic
and cut -through traffic. I have yet to
see it be implemented, and I've seen it
talked about for years, but I will say to

you, that should it be implemented, I
think that there's still an ability to
provide a stop, the way, for instance,
Morningside and some other neighborhoods
have, where you leave a dead-end
condition, where that dead-end driveway
serves to provide access to the commercial
buildings on the avenue, but not interfere
with the continuing traffic into the
residential area.
So you could, in effect, have a
two-way condition for a very short sort of
dead-end stump, so to speak, T -turn
around, and then have a one-way condition
through the neighborhood coming out. I
think that would be a real ideal situation
that we would all favor.
BOARD MEMBER MARSTON: Okay. I have
one further comment, was that I'm a little
concerned about the mural and the fact
that it's a blank at the moment.
MR. KARP: Yeah.

certainly if this does go forward, I
certainly think that we need to have some

looking at the two buildings, and I say I
see a tweak. I don't see the new building
being one which I think has made strong
gestures to the historic community. And,
you know, I'm just speaking as a designer.

buildings in context in the neighborhood,
which do have, if you will, a more

think we all agree, is made of -- whether
it's streamline or whether it's
Mediterranean revival, there are projects
and buildings, which have been built over
the past 50, 60 years, which are a
reflection of the time.
And what we are trying to do is --
and, again, you know, you can see to this
building right here next door, it has the
commercial and then it has the punched
windows on top.
What we are trying to do is, you
can -- we discussed it in the last
meeting, is that we felt that if we can

bring back like Emilio Robba, if we can

bring back the bulkhead, if we can bring

in the contemporary look, like, you know,
4
those images 6521, which do have the more

contemporary look to them, and there is

large glass, not only in the commercial,

but also there were pictures of the

resi denti al .

For example, if you look at the

residential, 6094, which is a

Mediterranean revival, if you look into

it, the quantity of glass in the ratio is

quite substantial.

So what we did -- and I understand

what you're thinking. And just to show

you that we are taking into consideration

and being respectful -- and I don't mind
18
working with staff further, Gerald, it's

fine.

What we did do is implemented, thank

you so much. The trellis work on the

facade of the building, which reflects the
23
historical patterns that exist onsite and
24
to reduce the quantity of glass that we do
25

know, Kobi, I would like you to eliminate
this and increase the stucco, I can look
into that as well. I don't have a problem
with that.
I feel that we did take the intent
and the desire, while at the same time
trying to come up -- because all it is, is
a two-story residential. And our floors I
think are 10 feet high. There are
single-family residential adjacent to us,
which are 12 and 14 feet high. And,
again, because due to close ventilation of
the historic homes. We are looking at in
that case of a sense.
And I think what we're saying is
that, if we can eliminate this height
right here, that's Number 1. We can
eliminate the height from floor to floor
for the residential and the commercial,
which is we brought down four feet, which
is 10% of the overall building height.
You know, so I feel we have taken 10% of
the height, plus elimination of the
features.
And then when we met with the

neighbors -- and, you know, listen, I

can't make everybody happy all the time,

but if I can make most of the people happy
4
most of the time, for example, within the
5
neighbors, there were people who said, no,
6
Kobi, I want it to be contemporary; I want
7
it to be of the time; I don't want it to
8
be a mimic, or a copy or more stucco.

So what we did, just to bring you a
10
little bit of insight to show you that we
11
are being respectful to the thought
12
process, I want you to take the stone
13
materials to be the stone materials that
14
we use in the neighborhood, whether it is
15
the terrazzo floor or whether it is the
16
keystone, so we took that and implemented
17
it. And the staircases, why don't you go
18
ahead and hide them, and tuck them in and
19
use that. And why don't you use materials
20
and patterns that you have historically on
21
the site and implement that. And so we
22
feel that we did that.

And, furthermore, when you look into
24
this design now, we feel that the size and
25
the width of the residential units that we

street, although immediately behind us we
have two-story apartment buildings with

Maybe the subject was discussed earlier.
On the recommendations from staff,
Item No. 1, you're saying that no CO will
be issued until the applicant secures the
structure. Was that discussed? Is that
already addressed?
MR. FERNANDEZ: It was mentioned by
staff, I believe, the condition, yes. And
we're obviously prepared to immediately
provide an improvement to the site.
Should we be able to obtain a demolition
permit immediately for construction, then
we would propose an attractive, decorative
wall or fence around the property, which
may be more appealing and aesthetically
pleasing to the neighborhood.
In the event that we cannot obtain a
demolition permit within a reasonable
period of time, we would, of course, need
to, you know, upgrade the structures, but
it certainly doesn't make sense to begin
to repair a home that has a broken roof
and needs entire paint, when it's going to
be demolished within a matter of weeks.

We can definitely have a nice fresco done
by an artist to represent and give a good
image to the neighborhood also.
