HomeMy WebLinkAboutR-14-0406City of Miami Legislation Resolution: R-14-0406 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00912xc Final Action Date: 10/9/2014 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING AN EXCEPTION, REQUIRING CITY COMMISSION APPROVAL, AS LISTED IN ARTICLE 6, TABLE 13, OF THE MIAMI 21 ZONING CODE, TO ALLOW A REGIONAL ACTIVITY COMPLEX FOR THE PROPERTIES LOCATED AT APPROXIMATELY 700 NORTH MIAMI AVENUE AND 700 NORTHWEST 1ST AVENUE, MIAMI, FLORIDA. WHEREAS, the Miami World Expo Center ("Expo Center") is a regional convention center and hotel destination with fully integrated, world -class exhibition and conference spaces; and WHEREAS, the Expo Center meets the requirements of a Regional Activity Complex under the Miami 21 Zoning Code by providing approximately 2,234,771 square feet of mixed -use development including approximately 350,000 square feet of usable exhibition space, approximately 1,800 hotel rooms, and off-street parking for more than 1,000 vehicles; and WHEREAS, the functionality of convention spaces requires that the majority of the space to be continuous and uninterrupted, with large clear heights and volumes to accommodate a broad variety of exhibitions, especially at the ground floor level; and WHEREAS, the Expo Center is to be located within the urban context of downtown Miami and within the existing network of streets and blocks; and WHEREAS, Article 6, Table 13, of the Miami 21 Zoning Code allows Regional Activity Complexes to consider any Transect regulation pertaining to Building Disposition and Building Configuration to be considered as referential guidelines, as well as providing for exemptions to the Transect regulations by complying with certain criteria; and WHEREAS, exemptions allowing increased lot coverage, reduced setbacks on secondary frontages, and reduced open space (at ground level) will allow for the inclusion of the ground level exhibition hall together with the necessary supporting back -of -house facilities in order to accommodate the functional requirements of the exhibition space; and WHEREAS, exemptions for the tower floor plate, setbacks above the eighth floor and maximum permitted tower length allow for appropriate utilization of that portion of the podium available for the tower; and WHEREAS, the applicant continues to work extensively with City staff to minimize the impact and extent of any requested exemptions, and will continue to work with City staff in the refinement of the project, as it further develops; and WHEREAS, the proposed Expo Center was reviewed by the Urban Development Review City of Miami Page 1 of 2 File Id: 14-00912xc (Version: 3) Printed On: 1/16/2018 File Number: 14-00912xc Enactment Number: R-14-0406 Board (UDRB) on September 17, 2014, and recommended approval with conditions; and WHEREAS, the Miami Planning, Zoning and Appeals Board ("PZAB"), at its meeting on October 1, 2014, following an advertised public hearing, adopted Resolution No. PZAB-R-14-064 by a vote of nine to zero (9-0), Item No. 1, recommending approval, with conditions as stated herein, of the Exception requiring City Commission approval as set forth; and WHEREAS, Article 6, Table 13 of the Miami 21 Zoning Code requires City Commission approval of an Exception; and WHEREAS, the City Commission after careful consideration of this matter, finds the application for Exception meets the applicable requirements of Ordinance No. 13114 of the Miami 21 Zoning Code and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to approve the Exception as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission is providing approval, as listed in Article 6, Table 13, of the Miami 21 Zoning Code, to allow a Regional Activity Complex for the properties located at 700 North Miami Avenue and 700 Northwest 1st Avenue, Miami, Florida as more particularly described in the attached Legal Description (Exhibit A), with the following conditions: i. Applicant shall continue to work with the City of Miami Planning and Zoning staff to bring the project more into compliance with regulations of Article 6, Table 13 -Supplemental Regulation and Recommendations. ii. Applicant shall obtain sufficiency letter from the Office of Transportation of the City of Miami. iii. Applicant shall comply with the conditions/comments of the City of Miami, Miami -Dade County and other agencies with jurisdiction over this proposed project. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
