HomeMy WebLinkAboutPre-LegislationCity of Miami Legislation Resolution: R-13-0448 City Hall 3500 Pan American Drive Miami, FL 33133 www.mlamigov.com File Number: 13-01233 Final Action Date: 11/21/2013 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT{S), AUTHORIZING THE SINGLE FAMILY REHABILITATION PROGRAM MAXIMUM SUBSIDY AMOUNT TO CHANGE FROM AN AMOUNT NOT TO EXCEED $35,000.00 TO AN AMOUNT NOT TO EXCEED $50,000.00, AS INDICATED IN EXHIBIT "A", ATTACHED AND INCORPORATED; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 05-0623, adopted November 3, 2005, the Miami City Commission approved a change to the Single Family Rehabilitation Program maximum amount from an amount not to exceed $30,000.00 to an amount not to exceed $35,000.00; and WHEREAS, the Department of Community and Economic Development has requested an increase in subsidy due to an increase in the cost of materials, the high levels of need within the existing housing community and the difficulty in attracting contractors since Miami -Dade County and other municipalities have higher limits; and WHEREAS, the City Administration recommends the Single Family Rehabilitation Program maximum subsidy amount to change from an amount not to exceed $35,000.00 to an amount not to exceed $50,000.00, as indicated in Exhibit "A", attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The Single Family Rehabilitation Program maximum subsidy amount change from an amount not to exceed $35,000.00 to an amount not to exceed $50,000.00, as indicated in Exhibit "A", attached and incorporated, is authorized. Section 3. The City Manager is authorized {1 } to execute all necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: City of Miami Page 1 of 2 File Id: 13-01233 (Version: 1) Printed On: 11/22/2013 File Number: 13-01233 Enactment Number: R-13-0448 {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten {10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. Eligible trade areas to include plumbing, electrical, roofing and structural. Same as current guidelines Funding SHIP and CDBG Same as current guidelines Type of Assistance Deferred payment 10 year loan used for repairs to property; 3% non -amortizing Same as current guidelines Minimum / Maximum Subsidy $1,000 / $35,000 `m ...: $1,000 / 'S0 00 Affordability Period 10 years Same as current guidelines Security Affordability period to be enforced by a second mortgage on the property Saone as current guidelines Repayment Requirements . In the ease of sale or transferor if the property ceases to be occupied as the primary residence, the borrower will be required to repay the original amount given as assistance as well as any accrued interest.
