I am a 13 year resident of this Historic Palm Grove Neighborhood and would like to
voice my concern with regard to 537 NE 70 street becoming again a "Daycare". As I
understand the law to be, this neighborhood has set in place rules for running a
business from your home. First and foremost you must live on the property to have
a "Live Work" business. And this daycare operator has no intention of living in the
home so for that I say no to the idea of allowing this business to proceed.
It would open the flood gates I am afraid to other business such as Dr. office, Law
etc. And then what?
Please do not allow this gate to open; we in thisarea
the burden on our neighbors.long to let any and every one do as they wantand put

Hello Mr. Powers,
I am resident living at 530 NE 64th Street. I recently learned that there exist the possibility of an outside
investor(s) attempting to open a daycare in our neighborhood. I DO NOT support this the existence of
this daycare. This move will lead to a decline in property value and discourage the gentrification of the
hard working people moving into our area. On 72nd and Biscayne, the Biscayne Boxing gym appears it
may go on the market soon. If anything, a Montessori School/Daycare should go there, or something
along those lines. Please let me know what I can do to stop this "daycare" from being the seed that
plagues our community.

Dear Sirs,
We would like to voice our concerns regarding the request for a daycare center to be operated from a
home located at 537 NE 70th Street, Miami Shores, Florida 33138 in our single family residential area.
We respectfully ask you to deny this request for the following reasons:
NOISE:
This will create constant noise with people idling their cars and trucks at various times, not to mention
loud music coming from their radios, and honking their horns while they are waiting to pick up their
child.
And how many times per day will the children be outside screaming (as children always do)? How can
this remain a quiet, peaceful neighborhood with a daycare center operating across the street?
TRAFFIC:
There will, of course, be additional traffic to our neighborhood as was the case when these same people
opened their daycare center the first time.
There was an increase in traffic and some were speeding as they were in a hurry to either drop off or
pick up their child. This makes it unsafe not only for the neighbors but the children going to the day care
center.
PARKING:
Parking is very limited on our street and like before, there will be double parking and congestion. What
about employee parking? Won't there have to be "spaces" for them to occupy during the entire day?
If someone wants to have a daycare, fine and 1 have nothing against children, but it's not appropriate in
a single family neighborhood. They should get a facility in a commercially zoned area.
And what next.... a "doggie daycare"? I also love animals, but I don't want a kennel across the street!

Here's my previous email... a preschool is allowed by EXCEPTION which means it's not by right so that
if zoning chooses not to issue it, she cannot do it...
I have three numbers written down for licensing: 850-717-4374 (Samantha I believe), 850-488-4900,
and 888-352-2842... Sorry I didn't take better notes on the phone numbers. You may want to see what
type of license that she would need to run a "pre-school" and ask what they call that type of childcare.
Ask them to explain what the requirements are, etc...
That little house is way too small for 27 kids all day long. What about fire safety, etc?

looking for an exception to zoning for 537 NE 70 St. This is a location that, to my understanding, she
conducted an illegal daycare from in the past and was finally shut down. I know this because after
being shut down, she came to Shorecrest and began an illegal daycare at 8629 N 8th Ct.
At 8629, while she had a license from the state for one service she was violating that license. In
addition to the fraudulent activities not aligned to her license, she was conducting daily daycare
operations out of a T3R location which is not allowed. It took a year to get operations ceased through
Code Compliance (I believe she operated for a total of two years here). She had no CU, no BTRs, etc
because the use was not allowed. After going before code compliance, operations stopped around
December.
Apparently, since that time she has been operating once again out of 537 NE 70 St. This time she is
calling it a pre-school. Her daily activities and schedule can be found on her website at

In talking with DCF licensing this morning, they still show the license for 8629 for which she had
been operating fraudulently (violating the license) and will be sending an inspector out to see that
operations have ceased. She does not have a license for 537 per the state DCF agent. DCF Tallahassee
said that they would send an inspector out to address operating without a license from their
perspective. She is once again operating without a CU and now without a license because the state

To me the issue if not one of "no child care in the Upper Eastside" or "no childcare in Palm Grove;"
instead, I am against introducing or allowing by exception, child care in a T3 zoning district, especially
within a single family/duplex historic district.
This would set a precedent that none of us want-- imagine if someone tried to allow a child care facility
in one of the Morningside homes or in Belle Meade or Bayside... Palm Grove should be treated no
differently.
The subject property, 537 NE 70 St, is
That said, childcare, as Miami 21 defines childcare as follows:
Childcare: A facility where six (6) or more children are cared for on a part-time basis by day or by
night including after -school care. The term does not include community based residential facilities,
Family Care Homes, foster homes, group homes, rehabilitation or detention centers, orphanages, or
other places
operating primarily for remedial care. See Article 6.
According to Miami 21 Article 6, Childcare may be allowed ONLY IN T4 & Higher zoning areas:
For T4:
For 6 to 10 children maximum:
Minimum of 35 square feet of usable indoor floor space
per child on license.
Minimum of 45 square feet of usable outdoor play area
per child.
A minimum outdoor play area shall be provided for one
half of license capacity. In no event shall any outdoor
play area be less than 450 square feet. The minimum
standard of outdoor play area does not apply for children
under one year of age.
Under no circumstance should this be permitted at 537 NE 70 St in Palm Grove.
