A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING A GRANT OF PUBLIC ACCESS EASEMENT FROM ALPINE
ESTATES, LLC ("GRANTOR"), FOR NON-EXCLUSIVE PUBLIC ACCESS
THROUGH THE GRANTOR'S PROPERTY LOCATED AT APPROXIMATELY 527
NORTHEAST 27TH STREET, MIAMI, FLORIDA BETWEEN NORTHEAST 27TH
STREET AND NORTHEAST 27TH TERRACE ALLEY, MIAMI, FLORIDA;
AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT OF PUBLIC
ACCESS EASEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID
PURPOSE.
WHEREAS, a condition of the development of the Crimson Tower project, located on Northeast
27th Street at Biscayne Bay, Miami, Florida, and the Icon Bay project, located on Northeast 28th
Street at Biscayne Bay, Miami, Florida, is the provision of a public "Baywalk" and linear park fronting
the Biscayne Bay inlet, between Northeast 27th Street and Northeast 29th Street, Miami, Florida; and
WHEREAS, it is desirable to provide continuous access and a connection for the general public,
between Northeast 27th Street and Northeast 27th Terrace Alley, Miami, Florida, the "Baywalk," and
the linear park located along the bayfront adjacent to the Crimson Tower project and the Icon Bay
project; and
WHEREAS, Alpine Estates, LLC ("Grantor") desires to grant to the City of Miami ("City") and the
public a non-exclusive 20 foot wide public access easement with a vertical clearance of 28 feet, in,
over, upon, across, and through a portion of their property located at approximately 527 Northeast
27th Street, Miami, Florida between Northeast 27th Street and Northeast 27th Terrace Alley, Miami,
Florida ("Property");
NOW, THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. A Grant of Public Access Easement from the Grantor, is accepted, for non-exclusive
public access through the Grantor's Property.
Section 3. The City Manager is authorized{1} to execute a Grant of Public Access Easement, in
substantially the attached form, for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by the City Commission.
