HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00859 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A DECLARATION OF RESTRICTIONS, IN SUBSTANTIALLY THE ATTACHED FORM, RUNNING WITH THE LAND FOR BRYAN PARK, LOCATED AT 2301 SOUTHWEST 13th STREET, MIAMI, FLORIDA, TO PRESERVE THE OPEN AND GREEN SPACE AS DEFINED IN MIAMI 21, AS DESCRIBED IN EXHIBIT "A." WHEREAS, the City of Miami ("City") plans to make certain improvements to Bryan Park; and WHEREAS, some neighbors have raised concerns that the proposed improvements will reduce the green space at Bryan Park; and WHEREAS, the City wishes to address the concerns of the neighbors by executing a Declaration of Restrictive Covenants, to ensure the existing greenspace at Bryan Park will be preserved as greenspace; and WHEREAS, the Declaration of Restrictions is to run with the property, and shall be binding on the City, its successors and assigns, and on all parties and persons claiming under them for a period of thirty (30) years from the date it is recorded, after which time it shall be extended automatically for successive periods of ten (10) years each, with terms and conditions as set forth in said Declaration of Restrictions; NOW, THEREFORE, BE IT RESOLVED BY.THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a Declaration of Restrictions, in substantially the attached form, running with the land for Bryan Park, located at 2301 Southwest 13th Street, Miami, Florida, to preserve the open and green space as defined in Miami 21, as described in Exhibit "A." Section 3. If the Mayor vetoes this resolution, it shall become effective immediately upon override of the veto by the City of Miami Commission.
