HomeMy WebLinkAboutR-14-0367City of Miami Legislation Resolution: R-14-0367 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00741 Final Action Date: 9/29/2014 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BYA FOUR -FIFTHS (4/STHS) AFFIRMATIVE VOTE AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, CONFIRMING, AND APPROVING THE CITY MANAGER'S RECOMMENDATION AND WRITTEN FINDINGS, PURSUANT TO SECTION 18-85 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING METHODS AS NOT BEING PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI FOR THE PROVISION OF CUSTODIAL SERVICES AT MIAMI CITY HALL; APPROVING THE AWARD OF SAID SERVICES TO UNITED CEREBRAL PALSY ASSOCIATION OF MIAMI, INC. (FORMERLY HOPE CENTER, INC.), FOR THE PERIOD OF OCTOBER 1, 2014 THROUGH SEPTEMBER 30, 2016, WITH OPTIONS TO RENEW FOR THREE (3) ADDITIONAL ONE (1) YEAR PERIODS, AT AN ANNUAL AMOUNT NOT TO EXCEED $68,888.00; WITH FUNDS ALLOCATED FROM THE DEPARTMENT OF GENERAL SERVICES ADMINISTRATION, PROPERTY MAINTENANCE, OTHER CONTRACTUAL SERVICES, ACCOUNT CODE NO. 05001.242000.534000.0000.00000; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSE. WHEREAS, the Office of the City Manager has determined that it is not practicable and advantageous to the City of Miami ("City") to adhere to competitive sealed bidding methods for the provision of custodial services at Miami City Hall ("City Hall"), currently performed by United Cerebral Palsy Association of Miami, Inc. (formerly Hope Center, Inc.) and, therefore, seeks a waiver of such requirements; and WHEREAS, the United Cerebral Palsy Association of Miami, Inc., established in 1947, is a non-profit organization whose mission it is to positively impact the quality of life for people with cerebral palsy, other developmental disabilities, and their family members and those with similar needs such as the frail and elderly, by providing support and service which aide in the achievement of their goals and desires, and works to provide programs and services meeting the special needs of each child and adult, and nurturing their talents and abilities in order to help them reach their greatest potential; and WHEREAS, the United Cerebral Palsy Association of Miami, Inc. strives for maximizing participation in the community through employment, by collaborating with many agencies throughout the State of Florida, including the City; and WHEREAS, when the Miami City Commission awarded Invitation for Bid ("IFB") No. 10606, for the provision of custodial services Citywide in January 2010, it delegated to the City Manager the authority to add or delete facilities, pursuant to Section 2.26 of the IFB, anticipating that City Hall would be removed to award said contract to Hope Center, Inc.; and City of Miami Page 1 of 2 File Id: 14-00741 (Version: 1) Printed On: 1/12/2018 File Number: 14-00741 Enactment Number: R-14-0367 WHEREAS, at that time, the City Commission opined that the City needed to be more socially responsible, and supported the mission of the Hope Center, Inc.; and WHEREAS, on July 1, 2014, United Cerebral Palsy Association of Miami, Inc. formally merged and acquired Hope Center, Inc.; and WHEREAS, pursuant to Section 18-85, of the Code of the City of Miami, Florida, as amended ("City Code"), the City Manager has waived competitive sealed bidding methods via a written finding with reasons supporting his conclusion therein; and WHEREAS, said conclusion must be ratified, confirmed, and approved by the Miami City Commission by a four -fifths (4/5ths) affirmative vote during an advertised public hearing; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's recommendation and written findings, pursuant to Section 18-85 of the City Code, are ratified, approved, and confirmed, the requirements for competitive sealed bidding methods are waived as not being practicable or advantageous to the City, for the provision of custodial services at Miami City Hall, and the award of said services to United Cerebral Palsy Association of Miami, Inc. (formerly Hope Center, Inc.), for the period of October 1, 2014 through September 30, 2016, with options to renew for three (3) additional one (1) year periods, at an annual amount not to exceed $68,888.00, are approved, with funds allocated from the Department of General Services Administration, Property Maintenance, Other Contractual Services, Account Code No. 05001.242000.534000.0000.00000. Section 3. The City Manager is authorized{1} to execute a Professional Services Agreement, in substantially the attached form, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} This herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of the ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
