HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00858 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT A TOTAL AMOUNT NOT TO EXCEED $419,166.00, IN THE FORM OF ONE (1) REIMBURSEMENT GRANT ("GRANT") FROM THE CHILDREN'S TRUST TO THE CITY OF MIAMI'S ("CITY'S") DEPARTMENT OF PARKS AND RECREATION ("DEPARTMENT") FOR THE HEART OF OUR PARKS OUT OF SCHOOL PROGRAM ("PROGRAM"); ESTABLISHING A NEW SPECIAL REVENUE PROJECT ENTITLED: "THE CHILDREN'S TRUST GRANT FOR PARKS 2014-2015," TO FUND THE DEPARTMENT'S PROGRAM AT ATHALIE RANGE PARK, JOSE MARTI PARK, ROBERTO CLEMENTE PARK, SHENANDOAH PARK, AND WEST END PARK, WITH IN -KIND SERVICES FROM THE CITY VALUED AT A NOT TO EXCEED AMOUNT OF $211,053.00 ("CITY MATCH"); APPROPRIATING THE GRANT FUNDS AND THE CITY MATCH; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE, IN A FORM ACCEPTABLE TO THE CITYATTORNEY, AN AGREEMENT WITH THE TRUST, AND TO NEGOTIATE AND EXECUTE ALL OTHER NECESSARY AMENDMENTS, EXTENSIONS, RENEWALS, AND MODIFICATIONS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO IMPLEMENT THE ACCEPTANCE OF AND COMPLIANCE WITH THE GRANT FOR SAID PURPOSES, FOR THE PERIOD COMMENCING AUGUST 1, 2014 THROUGH JULY 31, 2015, WITH THE OPTIONS TO RENEW FOR TWO (2) ADDITIONAL SIMILAR PERIODS AT THE SAME NOT -TO -EXCEED AMOUNTS, UNDER THE SAME TERMS AND CONDITIONS, SUBJECT TO BUDGETARYAPPROVAL AT THE TIME OF NEED. WHEREAS, the City of Miami's ("City's") Department of Parks and Recreation ("Department") has been awarded one (1) reimbursement grant ("Grant") from The Children's Trust ("Trust") for Out of School Programs in the not to exceed amount of $419,166.00, for the Department's Heart of Our Parks Out of School Program ("Program"), for the Program to continue providing services during the 2014-2015 Program period commencing August 1, 2014 through July 31, 2015; and WHEREAS, the City and the Trust are negotiating the form of contract ("The Children's Trust Contract") for said purposes for the new Program period; and WHEREAS, the Program is comprised of a cooperative effort between the Department and three (3) not -for -profit organizations: Amigos for Kids, Arts for Learning, and the Miami -Dade Family Learning Partnership; and WHEREAS, the goal of the Program is to improve the overall health, well-being, and academic achievement of children, and to decrease their involvement in behaviors that may put them at risk; and WHEREAS, the City must execute one (1) award package including the new form of The Children's Trust Contract, to accept the Grant in order to enter into similar professional service agreements with the not -for -profit organizations, and in order to comply with the Trust's requirements; and City of Miami Page 1 of 3 File Id: 14-00858 (Version: 1) Printed On: 9/17/2014 File Number: 14-00858 WHEREAS, Amigos for Kids was determined by the -Department to be the most advantageous not -for -profit organization and in the City's best interest to provide,program management, teacher supervision, family events, and other such activities at Jose Marti Park; and WHEREAS, Arts for Learning was determined by the Department to be the most advantageous not -for -profit organization and in the City's best interest to provide art, music, drama, and dance instruction at Athalie Range Park, Roberto Clemente Park, Shenandoah Park, and West End Park; and WHEREAS, Miami -Dade Family Learning Partnership was determined by the Department to be the most advantageous not -for -profit organization and in the City's best interests to provide literacy instruction, teacher supervision, and family literacy activities at Athalie Range Park, Roberto Clemente _. Park, Shenandoah Park, and West End Park; and WHEREAS, the City Manager and the Department, by separate Resolution today, after a required public hearing, are `requesting that the City Commission authorize' the City Manager to execute Service Authorizationtetters and to negotiate and execute Professional Service Agreements ("Agreements") in compliance with the final form of The Children's Trust Contract, respectively, with Amigos for Kids, for an amount not to exceed $68,759.00, Arts for Learning, for an amount not to - exceed $43,776.00, and the Miami -Dade Family Learning Partnership, for an amount not to exceed $51,693.00, for the period of August 1, 2014 through July 31, 2015, with the options to extend for two (2) additional similar periods for the same not -to -exceed amounts, subject to budgetary approval at time of need; and WHEREAS, the City Manager and the Department are requesting the appropriation of said Grant funding and the required City in -kind services match in a not to exceed amount of $211,053.00 for these Agreements with the respective not -for -profit organizations, for Fiscal Year 2014-2015, with future Fiscal Year funding subject only to budgetary approval at time of need; NOW THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{1} to accept a total not to exceed amount of $419,166.00, in the form of one (1) reimbursement grant ("Grant") from the Trust to the City's Department for the Program at Athalie Range Park, Jose Marti Park, Roberto Clemente Park, Shenandoah Park, and West End Park, with in -kind services from the City valued at a not to exceed amount of $211,053.00. Section 3. The following new Special Revenue Project is established, and resources are appropriated for the Program as described below: PROJECT TITLE: The Children's Trust Grant for Parks 2014-2015 RESOURCES: The Children's Trust $419,166.00 City of Miami Page 2 of 3 File Id: 14-00858 (Version: 1) Printed On: 9/17/2014 File Number: 14-00858 City In -Kind Services Match $211,053.00 APPROPRIATION: The Children's Trust Grant for Parks 2014-201T5 $630,219.00 Section 3 The City Manager is further authorized{1} to negotiate and execute, in a form acceptable to the City Attorney, an agreement with the Trust, and to negotiate and execute all other necessary amendments, extensions, and modifications, in a form acceptable to the City Attorney, to implement acceptance of and compliance with the Grant for said purposes, for the period commencing August 1:2014 through July-31, 2015, with the options to renew for up to two (2) additional similar periods at the same not to exceed amounts, under the same terms and conditions, subject to budgetary approval at time of need. Sectio T is Resolution shall become effective immediately upon its adoption and signature of the May {2}' APPROVED" S TO F.RM AND CORRECTNESS: VICTORIA ME ITY ATTO Footnotes: {1} The herein authorization is further subjected to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this resolution, it shall become effective immediately upon override of the veto by the City of Miami Commission.
