WHEREAS, the City of Miami's ("City") Department of Parks and Recreation, Day Care Division sponsors a year-round Food Service Program ("Program") for preschool -aged children which provides nutritional meals as a part of its child day care services program in City parks; and WHEREAS, the Florida Department of Health, Bureau of Children Nutrition Programs ("State") as administrator for the United States Department of Agriculture ("USDA") Child and Adult Care Food Program CFDA # 10.558 provides entitlement funding to the City to conduct the Program from October 1, 2013 through September 30, 2014 for preschool aged children; and WHEREAS, said entitlement funding is payable on a reimbursement basis in the estimated amount of $80,000 and is based on year 2012 figures and reimbursement rates may later be adjusted by the USDA or the Department of Health ("DOH"); and WHEREAS, the USDA and the DOH have provided the form of the Permanent Contract, from previous program years, attached and incorporated, which will be the form of contract used for Fiscal Year2013-2014; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as fully set forth in this Section. The following new Special Revenue Project for Fiscal Year 2013-2014 is established and resources are appropriated as described herein: FUND TITLE: Child Day Care Food Program RESOURCES: Florida Department of Health, Bureau of Children $80,000 Nutrition of Agriculture Child and Adult Care Food Program (CFDA #10.588) APPROPRIATIONS: Child Day Care Food Program 2013-2014 $80,000 Section 3. The City Manager is authorized {1} to accept such entitlement funding on a reimbursement basis and to execute the necessary documents, in a form acceptable to the City Attorney, in order to implement the acceptance of and compliance with said entitlement award for the operations of the Program for preschool aged children in the City's Parks, in the estimated not to exceed amount of $80,000, from October 1, 2013 through September 30, 2014. Section 4. Theexpenditure of the entitlement funds are authorized for the operations of the Program, with such authorization remaining valid and outstanding even if the anticipated entitlement award is reduced or increased Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS: Is n I VIORIAIMENDEZ CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
