HomeMy WebLinkAboutR-14-0358City of Miami Legislation Resolution: R-14-0358 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00874a Final Action Date: 9/11/2014 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), INSTRUCTING THE CITY ADMINISTRATION AND THE OFFICE OF THE CITY ATTORNEY TO TAKE THE NECESSARY STEPS TO CREATE A QUIET ZONE ALONG THE CSX DOWNTOWN SPUR CORRIDOR IN ALLAPATTAH, SEEK FUNDING THROUGH THE FLORIDA DEPARTMENT OF TRANSPORTATION RAILROAD QUIET ZONES GRANT PROGRAM, AND BEGIN THE ANALYSIS NECESSARY TO CREATE A CITY WIDE QUIET ZONE. WHEREAS, the late night and early morning sounding of train horns along the CSX Downtown Spur corridor in Allapattah has created a nuisance for the residents living along the corridor; and WHEREAS, the creation of a quiet zone along this corridor will alleviate the nuisance to the residents and increase the quality of life; and WHEREAS, the proposed quiet zone along the CSX Downtown Spur corridor in Allapattah will be from Northwest North River Drive South of Northwest 36 Street on the West, to Northwest 10 Avenue on the East, Miami, Florida, as depicted in "Exhibit A," attached and incorporated; and WHEREAS, the City Commission wishes to create a quiet zone along the CSX Downtown Spur corridor in Allapattah; and WHEREAS, creation of a quiet zone requires taking an inventory of crossings along the corridor, following the Federal Rail Administration's Quiet Zone implementation process, and providing a Notice of Intent to establish a quiet zone to the Florida Department of Transportation ("FDOT"); and WHEREAS, FDOT has provided funding for local communities that wish to create quiet zones through their Railroad Quiet Zones Grant Program; and WHEREAS, the City Commission is instructing the City Administration and Office of the City Attorney to take the necessary steps to create a quiet zone along the CSX Downtown Spur corridor in Allapattah, seek any funding available through the FDOT Railroad Quiet Zones Grant Program, and begin the analysis necessary to create a Citywide quiet zone; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Administration and Office of the City Attorney are instructed to take the necessary steps to create a quiet zone along the CSX Downtown Spur corridor in Allapattah, seek funding through FDOT Railroad Quiet Zones Grant Program, and begin the analysis necessary to City of Miami Page 1 of 2 File Id: 14-00874a (Version: 1) Printed On: 1/11/2018 File Number: 14-00874a Enactment Number: R-14-0358 create a Citywide quiet zone. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
