A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING AN
ADDITIONAL OWNER CONTINGENCY ALLOWANCE TO THORNTON
CONSTRUCTION CO., INC., FOR THE NEW DINNER KEY MARINA DOCK
MASTER BUILDING PROJECT, NECESSITATED DUE TO THE DEPLETION OF
THE ORIGINAL TEN PERCENT (10%) CONTINGENCY AMOUNT OF $376,364.10,
WHICH HAS BEEN UTILIZED TO CONSTRUCT PHASE II OF THE PROJECT, A
10,180 SQUARE FEET WATERFRONT PLAZA, IN THE AMOUNT NOT TO EXCEED
$376,364.10 FOR PHASE I AND PHASE II OF THE PROJECT, THEREBY
INCREASING THE AWARD VALUE FROM $4,140,005.10, TOATOTALAMOUNT
NOT TO EXCEED $4,516,369.20; ALLOCATING FUNDS FOR SAID INCREASE
FROM CAPITAL IMPROVEMENT PROJECT NUMBERS B-60464 AND B-604645.
WHEREAS, pursuant to Resolution No. 12-0415, adopted October 25, 2012, the City Commission
authorized the execution of a construction contract with Thornton Construction Co., Inc. ("Thornton")
for the New Dinner Key Marina Dock Master Building Project No. B-60464 ("Project") in the amount of
$3,763,641.00, for the scope of work, plus a ten percent (10%) contingency of $376,364.10, for a
total award value not to exceed $4,140,005.10; and
WHEREAS, the cost of Phase II of the Project was originally included with the bid as an add
alternate item option which was initially put on hold; and
WHEREAS, the Capital Improvements and Transportation Program, at the request of the
Department of Public Facilities, has now moved forward with Phase II of the Project to construct a
new 10,180 square feet waterfront plaza in order to be Leadership in Energy and Environmental
Design Certified Silver Level or higher, consisting of new brick pavers, lighting, landscaping, fire
department connections and storm drainage; and
WHEREAS, due to the owner's requested changes that occurred subsequent to the contract
award, the addition of Phase II, and the existing owner contingency having been utilized in full, it is
now necessary to replenish the Project's depleted contingency in the amount of $376,364.10, for both
Phase I and Phase II of the Project, to cover unforeseen expenses and anticipated owner requested
changes, not limited to, a request by the City of Miami Police Department for area security and
surveillance systems not originally contemplated for the Project; and
WHEREAS, funds are to be allocated from Capital Improvement Project Numbers B-60464 and
B-604645;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.

Section 2. An additional owner contingency allowance to Thornton for the Project, necessitated
due to the depletion of the original ten percent (10%) contingency amount of $376,364.10, which has
been utilized to construct Phase II of the Project, a 10,180 square feet waterfront plaza, in the
amount not to exceed $376,364.10 for Phase I and Phase II of the Project, thereby increasing the
award value from $4,140,005.10, to a total amount not to exceed $4,516,369.20, is authorized, with
funds allocated from Capital Improvement Project Numbers B-60464 and B-604645.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
