HomeMy WebLinkAboutR-14-0326City of Miami Legislation Resolution: R-14-0326 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00773 Final Action Date: 9/11/2014 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A MUTUAL AID AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND MIAMI-DADE COUNTY ("COUNTY"), TO RECEIVE AND EXTEND MUTUAL AID IN THE FORM OF GANG INVESTIGATIONS AND ENFORCEMENT WITH THE COUNTY'S MULTI -AGENCY GANG TASK FORCE, TO APPREHEND AND PROSECUTE CRIMINAL GANG MEMBERS THAT CROSS JURISDICTIONAL BOUNDARIES AS DEFINED IN PART 1, CHAPTER 23, OF THE FLORIDA STATUTES. WHEREAS, Miami -Dade County ("County") and the City of Miami ("City") have the authority under Section 23.12, Florida Statutes, et. seq., the Florida Mutual Aid Act, to enter into a Mutual Aid Agreement; and WHEREAS, the City and the County recognize that criminal gangs do not operate with regard to jurisdictional boundaries; and WHEREAS, the purpose of this Mutual Aid Agreement is to allow the City to assist the County with its Multi -Agency Gang Task Force ("MAGTF") which was created to conduct proactive gang enforcement operations and investigate criminal gang activity in order to apprehend and prosecute criminal gang members who are outside of the jurisdictional boundaries of the City; and WHEREAS, pursuant to the Florida Interlocal Cooperation Act of 1969, §163.01 Florida Statutes, the City and the County have the authority to enter into agreements to jointly exercise any power, privilege, or authority which they share in common and which each might exercise separately; NOW THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a Mutual Aid Agreement, in substantially the attached form, between the City and the County, to receive and extend mutual aid in the form of gang investigations and enforcement with the County's Multi -Agency Gang Task Force, to apprehend and prosecute criminal gang members that cross jurisdictional boundaries as defined in Part 1, Chapter 23, of the Florida Statutes. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
