URBAN DESIGN FINDINGS AND COMMENTS:
1. The proposed rezoning complies with the successional change as allowed in
Miami 21 Code.
2. This request need a companion item for land use change to the subject parcel
from "Single Family Residential" to "Low Density Restricted Commercial", to comply
with the Miami Comprehensive Neighborhood Plan (MCNP)

3. The subject parcels are currently vacant.
4. The adjacent parcels to the east, north, and south along the NW 36th Court are
designated T3-O (Sub -Urban Transect Zone -Open). The areas to the west are
designated T6-8-O (Urban Center Transect Zone- Open)
5. Even though the proposed zoning change from T3-O to T4-O allows transition
between parcels zoned T6-8-O and T3-O, a change to T4-O will allow for
entertainment establishments, food service establishments, alcohol beverage
service establishments, and general commercial uses that will be incompatible within
the T3-O established residential area immediately to the north, east, and south of
the subject property. Thus, the rezoning request represents a clear commercial
intrusion within the T3-O residential area. .
6. A zoning change for the subject property, as proposed, may set a negative
precedent and create a "domino effect" in regards to future zoning change
applications.
7. The Planning and Zoning Department recommends that a zoning change to T4-L
will be more appropiate because It establishes an appropriate transition in scale,
density and intensity to the lower intense transect zones to the east,
Based on the above findings, the Planning and Zoning Department recommends Denial
of the application as presented.

Dear Mr. Garcia,
The undersigned is the legal representative of West Flagler Associates, LTD, the Owner
of the properties subject to the application ("Applicant"). These two blocks have been owned by
the Applicant since the early 1950's. and, since that time, have been vacant and/or used for
parking to serve the Flagler Dog Track, the flea market at Flagler Dog Track during the 1990's,
and now, Magic City Casino. Magic City Casino is owned and operated by the Applicant.
This application requests a zoning and land use change for those portions of these two
blocks that are zoned for duplex residential to create two blocks suitable for commercial
development along N.W. 37th Avenue, a Section Line road. The portions of the blocks that have
frontage along N.W. 37th Avenue are zoned T6-8 0, while the abutting portions of the blocks, to
the east are zoned for duplex residential uses. The current zoning boundaries of the two blocks
do not even follow the platted lots.
As you may recall, the portion of N.W. 4th Terrace that lies between the subject property
was recently closed pursuant to Resolution No. 13-0385 (adopted on September 26, 2013). That
road closure approval is part of the re -platting of the two blocks fronting S.W.37th Avenue to
create a commercial tract of sufficient size to accommodate commercial development, potentially

a full service restaurant, to service the growing number of visitors and residents of the area. That
re -platting is currently underway.
This portion of N.W. 37 Avenue, which is a major section line road, is one of the
gateways to Miami International Airport. Development of this parcel with commercial/restaurant
uses is appropriate and desirable to serve this area. Developments that include sufficient
offstreet parking and satisfy the design criteria of Miami 21, require a larger parcel of
developable land. In addition, the buffer and design safeguards of Miami 21 will ensure that
any proposed commercial development will be appropriately designed to protect the surrounding
residential areas. Finally, the zoning change to T4-O will also provide a transition between the
T6-8 0 frontage along 37th Avenue and the T3-0 residential areas to the west.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
CLOSING, VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE A
STREET (NORTHWEST 4TH TERRACE) LOCATED BETWEEN NORTHWEST
36TH COURT AND NORTHWEST 37TH AVENUE AND BETWEEN NORTHWEST
4TH STREET AND NORTHWEST 5TH STREET, MIAMI, FLORIDA.
WHEREAS, the Plat and Street Committee, at its meeting on October 4, 2012, has reviewed the
subject tentative plat and determined that all technical requirements have been met and by a vote of
seven to zero (7-0) the Plat and Street Committee recommends DENIAL of the vacation and closure
as set forth; and
WHEREAS, the Department of Public Works and the Plat and Street Committee have studied the
subject vacation and closure and determined that it will affect pedestrian or vehicular traffic circulation
or access for public service; and
WHEREAS, the Miami Planning, Zoning and Appeals Board ("PZAB"), at its meeting on June 19,
2013, following an advertised public hearing, adopted Resolution No. PZAB-R-13-030 by a vote of
eight to one (8-1), item no. 1, recommending DENIAL of the vacation and closure as set forth; and
WHEREAS, the City Commission, finds that it is in the best interest of the general welfare of the
City of Miami and its inhabitants to grant the vacation and closure of a portion of the public right-of-way
as hereinafter described, and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The street (Northwest 4th Terrace) located between Northwest 36th Court and
Northwest 37th Avenue and between Northwest 4th Street and Northwest 5th Street, Miami, Florida,
more particularly described in Exhibit "A," is closed, vacated, abandoned and discontinued for public
use.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {1}

Miami 21, Article 7.1.2.8, c.2 (2) Analysis
The accompanying materials provide an analysis of the properties within a half mile radius of the subject property and
provide planning and zoning support for the requested change in land use designation and zoning transect.
Exhibit 1.1(a) and 1.1 (b) consist of aerials of the Property depicting the site's location on N.W. 37th Avenue, a major
Section Line, the existing site conditions (vacant, undeveloped) and the residential uses to the east, which support the
request for a land use change and rezoning for the entire block to create commercial development opportunities and to
provide appropriate transitional and successional zoning between the permitted T6-8 0 Commercial and Restricted
Commercial designations along NW. 37th Avenue, and Magic City Casino and the duplex and single family residential
areas to the east.
Exhibit 1.2 depicts the Property's designation as "Low Density Residential " in the City's Future Land Use Plan Map
