Purpose of Item: Resolution of the Miami City Commission accepting the final plat of RESORTS WORLD MIAMI ONE from RESORTS WORLD MIAMI LLC, and authorizing the City Manager to execute the related documents for the recordation of the plat and approving recording the same in the Public Records of Miami -Dade County, Florida; and accepting a non-exclusive Drainage Easement and a non-exclusive Emergency Vehicle Access Easement; further, authorizing and directing the City Manager to execute a Release of Grant of Easement and Restrictive Covenants. Director Chief �/ City Manager Page 1 of 2 The Plat and Street Committee established per Miami City Code Section 55-1, and composed of the Departments of Public Works, Planning and Zoning, Building, Police, Fire -Rescue, General Service Administration, and Solid Waste, with representation of the Law Department, has reviewed the Tentative Plat and determined its conformance to the subdivision regulations of Chapter 55, and 1 Miami21 Zoning Regulations. The Department of Public Works has reviewed the final plat and has determined that it is now in order for acceptance by the Miami City Commission. The specific intent of this plat is to close the Easements within the proposed plat and to create 1 tract, as well as multiuse development. The proposed plat entitled RESORTS WORLD MIAMI ONE is a subdivision of the property described in the legal description shown as Attachment 1. The platted area consists of approximately 247,446 square feet (5.68± acres) as depicted in Exhibits B and C. This plat was approved under zoning designations T6-36B-O (Urban Core Zone). In order to ensure adequate emergency vehicle access for adjacent properties and to provide continuity of the storm water drainage system, the Plat and Street Committee has requested, and the property owner has provided, a non-exclusive Emergency Vehicle Easement and a non-exclusive Drainage Easement by separate instrument upon the "Resorts World Miami One" plat property. It is now in order to accept this easements. On February 7, 1983, the former owners of the property, Knight-Ridder Newspapers, Inc., granted an easement and restrictive covenants to the City related to the creation of a pedestrian walkway along the bay front of The Herald property. The easement and restrictive covenants additionally contains walkway development and use restrictions that are no longer applicable to the proposed development of the property. The concept of a pedestrian walkway along the bay front would subsequently be known as the "Baywalk" and is incorporated into the land development regulations of the Miami 21 Zoning Code. All new development along the waterfront, including Biscayne Bay, must comply with the requirements of Section 3.11 of the Miami 21 Zoning Code including, but not limited to, waterfront setbacks and Waterfront Design Standards found in Appendix 3 of the Miami 21 Zoning Code. The Grant of Easement and Restrictive Covenants is no longer necessary or applicable to the proposed development of the property and it is respectively recommended that the City Manager and the City Clerk be authorized and directed to execute a Release of Grant of Easement and Restrictive Covenants.
