HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00571 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ACCEPTING THE PLAT ENTITLED "RESORTS WORLD MIAMI ONE", A SUBDIVISION IN THE CITY OF MIAMI OF THE PROPERTY DESCRIBED IN "ATTACHMENT 1", SUBJECT TO THE SATISFACTION OF ALL CONDITIONS REQUIRED BY THE PLAT AND STREET COMMITTEE AS SET FORTH IN "EXHIBIT A", ATTACHED AND INCORPORATED, AND THE PROVISIONS CONTAINED IN SECTION 55-8 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AND ACCEPTING THE DEDICATIONS SHOWN ON THE PLAT; AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT; PROVIDING FOR THE RECORDATION OF THE PLAT IN THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA; AND ACCEPTING A NON-EXCLUSIVE DRAINAGE EASEMENT AND A NON-EXCLUSIVE EMERGENCY VEHICLE ACCESS EASEMENT, IN FAVOR OF THE CITY OF MIAMI, UPON THE "RESORTS WORLD MIAMI ONE" PLAT PROPERTY; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A RELEASE OF GRANT OF EASEMENT AND RESTRICTIVE COVENANTS, IN SUBSTANTIALLY THE ATTACHED FORM. WHEREAS, the Plat and Street Committee, established pursuant to Chapter 55 of the Code of the City of Miami, Florida, as amended ("City Code"), at its meeting of September 5, 2013, reviewed this proposed plat and determined that all technical requirements have been met; and WHEREAS, the Plat and Street Committee recommends the acceptance of the plat entitled "Resorts World Miami One"; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The plat entitled "Resorts World Miami One", a subdivision of the property described in "Attachment 1", which said plat by reference, in substantially the attached form, and subject to the satisfaction of all conditions required by the Plat and Street Committee as set forth as "Exhibit A", attached and incorporated, and the provisions contained in Section 55-8 of the City Code, is accepted. The dedications shown on the plat together with the dedications to the perpetual use of the public of all existing and future right-of-way improvements, planting, trees and shrubbery on said property are also accepted and confirmed by the City of Miami, Florida ("City"). Section 3. The City accepts the non-exclusive Drainage Easement and the non-exclusive Emergency Vehicle Access Easement, attached and incorporated, as "Exhibits B and C". Section 4. The City Manager is authorized{1} to execute a Release of Easement and Restrictive Covenants, in substantially the attached form, as "Exhibit D". Any development on the property described in "Attachment 1", must comply with all requirements of Section 3.11 of Miami 21, including, but not limited to, waterfront setbacks and waterfront walkways, as well as "Appendix B" of the Miami 21 Waterfront Design Guidelines. Section 6. The City Manager and the City Clerk are authorized{1} and directed to execute the plat and cause the same to be recorded in the Public Records of Miami -Dade County, Florida. Section 7. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FO AND CORRECTNESS: VICTORIA MENDEZ CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
