HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00567 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT OF EASEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH MIAMI-DADE COUNTY WATER AND SEWER DEPARTMENT, A POLITICAL SUBDIVISION OF THE STATE OF FLORIDA, OF AN APPROXIMATELY TWELVE (12) FOOT WIDE STRIP OF CITY OF MIAMI OWNED PROPERTY LOCATED AT 1095 BISCAYNE BOULEVARD, MIAMI, FLORIDA, (KNOWN AS MUSEUM DARK), AS MORE P.ARTICUL ARLY DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED, TO CONSTRUCT, RECONSTRUCT, LAY, INSTALL, OPERATE, MAINTAIN, RELOCATE, REPAIR, REPLACE, IMPROVE, REMOVE, AND INSPECT WATER TRANSMISSION AND DISTRIBUTION FACILITIES AND ALL APPURTENANCES THERETO, WITH FULL RIGHT TO INGRESS THERETO AND EGRESS THEREFROM ON THE PROPERTY. WHEREAS, Miami -Dade County Water and Sewer Department ("County") has requested the grant of easement of an approximately twelve (12) foot wide strip of City of Miami ("City") owned property located at 1095 Biscayne Boulevard, Miami, Florida, (also known as Museum Park) ("Property"), more particularly described in Exhibit "A", attached and incorporated; and WHEREAS, this easement will be used for future maintenance of said facilities; and WHEREAS, the easement shall further contain a reverter provision that if the easement is abandoned or discontinued, the easement shall cease and revert back to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a Grant of Easement, in substantially the attached form, with the County, a political subdivision of the State of Florida, of an approximately twelve (12) foot wide strip of City -owned Property (also known as Museum Park), as more particularly described in Exhibit "A", attached and incorporated, to construct, reconstruct, lay, install, operate, maintain, relocate, repair, replace, improve, remove, and inspect water transmission and distribution facilities and all appurtenances thereto, with full right to ingress thereto and egress therefrom on the property. Section 3.
