HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00561 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BYA FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDINGS AND RECOMMENDATIONS THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS PURSUANT TO SECTIONS 18-85(A) AND 18-86(A)(3)(C) OF THE CODE OF THE CITY OF MIAMI, FLORIDA., AS AMENDED; WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; APPROVING THE FINDINGS AND RECOMMENDATIONS OF THE CITY OF MIAMI'S DEPARTMENT OF GRANTS ADMINISTRATION, EDUCATION INITIATIVES THAT ARTS FOR LEARNING/MIAMI, INC., A FLORIDA NOT -FOR -PROFIT ORGANIZATION, AND EXCEPTIONAL CONSULTING EDUCATIONAL LEADERS, INC., A FLORIDA FOR -PROFIT CORPORATION, ARE THE MOST QUALIFIED FIRMS TO PROVIDE INSTRUCTION, FAMILY ACTIVITIES, MENTORING, COMMUNITY WORKSHOPS AND OTHER SUCH ACTIVITIES IN CONJUNCTION WITH EDUCATIONAL SERVICES AT KINLOCH PARK AND CURTIS PARK FOR THE MIAMI LEARNING ZONE OUT OF SCHOOL PROGRAM ("PROGRAM"); AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND TO EXECUTE, AFTER CONSULTATION WITH THE CITY ATTORNEY, SERVICE AUTHORIZATION LETTERS, PROFESSIONAL SERVICE AGREEMENTS, AND AMENDMENTS, EXTENSIONS, RENEWALS, AND MODIFICATIONS IN COMPLIANCE WITH THE RELATED FORM OF THE CHILDREN'S TRUST CONTRACT, RESPECTIVELY, WITH: EXCEPTIONAL CONSULTING FOR EDUCATIONAL LEADERS, INC., IN AN AMOUNT NOT TO EXCEED $20,000.00 AND ARTS FOR LEARNING/MIAMI, INC., IN AN AMOUNT NOT TO EXCEED $14,000.00, FOR A PERIOD COMMENCING AUGUST 1, 2014 THROUGH JULY 31, 2015, WITH THE OPTION TO RENEW FOR UP TO TWO (2) ADDITIONAL SIMILAR PERIODS AT THE SAME NOT TO EXCEED AMOUNTS, UNDER THE SAME TERMS AND CONDITIONS, FOR THE PROGRAM, SUBJECT TO BUDGETARY APPROVAL AT THE TIME OF NEED. WHEREAS, the City of Miami's ("City") Department of Grants Administration, Education Initiatives ("Department") has been awarded a reimbursement grant from The Children's Trust ("Trust") for the City's Miami Learning Zone Out of School Program ("Program"), in an amount not to exceed $86,722.00 ("Grant"), for the period from August 1, 2014 through July 31, 2015, for services for the Program to be provided at Kinloch Park and Curtis Park, and pursuant to the negotiated form of contract ("Trust Contract"), between the City and the Trust for said purposes; and WHEREAS, pursuant to a Resolution, adopted earlier today on July 24th, 2014, the City Commission has accepted the Grant award, authorized the negotiation and execution of the Trust Contract, and authorized related appropriations, allocations and creation of the related Special Revenue Project for The Children's Trust Grant for Education Initiatives 2014-2015 for funding the Program; and City of Miami Page 1 of 3 File Id: 14-00561 (Version: 1) Printed On: 7/10/2014 File Number: 14-00561 WHEREAS, the Program is comprised of a cooperative effort between the Department and one (1) not -for -profit organization, Arts for Learning/Miami, Inc., and one (1) for -profit corporation, Exceptional Consulting for Educational Leaders, Inc., (collectively, "Service Providers") for its successful implementation; and WHEREAS, the Program's goals are to improve health and well-being, increase academic achievement, and decrease involvement in behaviors that may put children at risk; and WHEREAS, the 2011-2012 Children's Trust Notice of Funding Application required that the City have established relationships with the Service Providers identified in the application and the related Trust Contract is a continuation of said services; and WHEREAS, Arts for Learning/Miami, Inc. was determined to be the most advantageous not -for -profit organization, in the City's best interest, to provide art, music, drama and dance instruction for the Program at Kinloch Park and Curtis Park; and WHEREAS, Exceptional Consulting for Educational Leaders, Inc. was determined to be the most advantageous for -profit corporation, in the City's best interest, to provide programmatic instruction at Kinloch Park and Curtis Park; and WHEREAS, the City Manager has approved the findings and recommendations of the Department, and has made findings that pursuant to Sections 18-85(a) and 18-186(a)(3)(c) of the Code of the City of Miami, Florida, as amended ("City Code"), competitive negotiation methods and procedures are not practicable or advantageous for obtaining said services, and has recommended to the City Commission that the findings and recommendations be adopted and that competitive bidding methods and procedures be waived for the Program; and WHEREAS, the City Manager and the Department are requesting for the City Commission to authorize the City Manager, after consultation with the City Attorney, to negotiate and execute Service Authorization Letters, Professional Service Agreements ("Agreements"), and any amendments, extensions, renewals, and modifications in compliance with the related form of Trust Contract, respectively, with: Exceptional Consulting for Educational Leaders, Inc., for an amount not to exceed $20,000.00; and Arts for Learning/Miami, Inc., for an amount not to exceed $14,000.00, for the period from August 1, 2014 through July 31, 2015 with the option to extend for two (2) additional similar periods for the same not to exceed amounts, under the same terms and conditions; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's findings and recommendations that competitive negotiation methods and procedures are not practicable or advantageous pursuant to Sections 18-85(a) an 18-86(a)(3)(c) of the City Code, waiving the requirements for said procedures, are ratified, approved and confirmed and the Department's findings and recommendations that Arts for Learning/Miami, Inc., a Florida not -for -profit organization, and Exceptional Consulting for Educational Leaders, Inc., a Florida for -profit organization, are the most qualified firms to provide instruction, family activities, mentoring, community City of Miami Page 2 of 3 File Id: 14-00561 (Version: 1) Printed On: 7/10/2014 File Number. 14-00561 workshops, and other such activities in conjunction with educational services at Kinloch Park and Curtis Park for the Program, are approved. Section 3. The City Manager is authorized{1} to negotiate and to execute, after consultation with the City Attorney, Service Authorization Letters, Agreements, and amendments, extensions, renewals, and modifications in compliance with the related form of Trust Contract, respectively, with: Exceptional Consulting for Educational Leaders, Inc., for an amount not to exceed $20,000.00; and Arts for Learning/Miami, Inc., for an amount not to exceed $14,000.00, for a period commencing August 1, 2014 through July 31, 2015, with the options to renew for up to two (2) additional similar periods at the same not to exceed amounts, under the same terms and conditions for the Program, subject to budgetary approval at time of need. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APP OVED AS TO FORM AND CQ.RRECTNESS VICTORIA MENDEZ CITYATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
