HomeMy WebLinkAboutPre-LegislationCrystal Report Viewer Page 1 of 2 City of Miami Text File Report City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File ID: 11-00340 Enactment #: R-11-0216 Version: 1 Type: Resolution Introduced: 4/12/11 Status: Passed Enactment Date: 5/26/11 Controlling Body: Office of the City Clerk A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 (A)(1) AND (3) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE BIDDING PROCEDURES AND APPROVING THE PROCUREMENT OF SERVICES AND REPLACEMENT PARTS/EQUIPMENT FOR THE AUTOMATED COMPUTERIZED FUEL FACILITY SYSTEM (FUELOMAT SYSTEM), FOR THE DEPARTMENTS OF GENERAL SERVICES ADMINISTRATION AND FIRE -RESCUE, FROM AHA ELECTRONIC AND FUEL SYSTEMS, INC., THE SOLE SOURCE PROVIDER, ON AN AS -NEEDED CONTRACTUAL BASIS, FOR A ONE (1) YEAR PERIOD, WITH THE OPTION TO EXTEND FOR TWO (2) ADDITIONAL ONE-YEAR PERIODS, WITH PRICES FIXED AND FIRM FOR THE THREE (3) YEAR PERIOD; ALLOCATING FUNDS FROM THE VARIOUS SOURCES OF FUNDS FROM THE USER DEPARTMENTS AND AGENCIES, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED. WHEREAS, the services and replacement parts/equipment ("Services") for the automated computerized fuel facility system (FuelOmat System) is needed for the City of Miami's ("City's") vehicles to be outfitted with the fuel collars and electronic components for the City's automated computerized fuel facility (FuelOmat) from AHA Electronic and Fuel Systems, Inc. ("AHA"); and WHEREAS, the Chief Procurement Officer has adopted the finding that AHA is the sole source provider of the Services for the FuelOmat System; and WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the findings of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recoimnend that the requirements for competitive formal sealed bids be waived, pursuant to Section 18-92(a)(1) and (3) of the Code of the City of Miami, Florida, as amended ("City Code"), and the procurement of Services for the FuelOmat System, as specified above, be approved as a sole source; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By a four -fifths (4/5ths) affirmative vote, pursuant to Section 18-92(a)(1) and (3) of the City Code, after an advertised public hearing, the City Manager's finding of a sole source is ratified, approved and confirmed, waiving the requirements for competitive sealed bidding procedures, and the procurement of Services for the FuelOmat System, for the Departments of General Services Administration and Fire -Rescue, from AHA, the sole source provider, is approved, on an as -needed contractual basis, for a one (1) year period, with the option to extend for two (2) additional one-year periods, with prices fixed and firm for the three (3) year period, with funds allocated from the various sources of funds from the user departments and agencies, subject to the availability of funds and budgetary approval at the time of need. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1 }
