HomeMy WebLinkAboutPre-LegislationCity of Miami Legislation Resolution: R-13-0489 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-01368 Final Action Date:12/12/2013 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE ALLOCATION OF NEIGHBORHOOD STABILIZATION PROGRAM 1 PROGRAM INCOME FUNDS IN THE AMOUNT NOT TO EXCEED $300,000.00, FOR THE CONSTRUCTION OF NEW AFFORDABLE HOMES AT THE CITY OF MIAMI OWNED SITES LOCATED AT 1477 NORTHWEST 60TH STREET, 1336 NORTHWEST 60TH STREET, 5852 NORTHWEST 13TH AVENUE, AND 1497 NORTHWEST 60TH STREET A/K/A 6005 NORTHWEST 15TH AVENUE, MIAMI, FLORIDA, LEGALLY DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED; AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 3 TO THE CONSTRUCTION CONTRACT WITH LINK CONSTRUCTION GROUP, INC., IN SUBSTANTIALLY THE ATTACHED FORM, FOR THE DESIGN AND CONSTRUCTION OF SINGLE-FAMILY INFILL HOUSING TO INCLUDE AN ADDITIONAL HOME. WHEREAS, pursuant to Resolution No. 10-0538, adopted December 16, 2010, the City Commission approved giving the City Manager authority to execute Purchase and Sale Agreements for the sale of fifteen (15) properties under the Neighborhood Stabilization Program ("NSP") and the Neighborhood Initiatives Program; and WHEREAS, out of the fifteen (15) properties, seven (7) have been built and sold through the City of Miami Department of Community and Economic Development First Time Homebuyer Program; and WHEREAS, three (3) properties are currently under construction and one (1) property was eliminated due to the Miami -Dade Water and Sewer issue; and WHEREAS, the remaining four (4) properties will be used for the construction of affordable homes; and WHEREAS, the contractor, Link Construction Group, Inc., is in need of additional funds to complete the affordable housing construction; and WHEREAS, the City Administration recommends the allocation of NSP 1 Program Income funds in the amount not to exceed $300,000.00, for the construction of new affordable homes of the City -owned sites located at 1477 Northwest 60th Street, 1336 Northwest 60th Street, 5852 Northwest 13th Avenue, and 1497 Northwest 60th Street a/k/a 6005 Northwest 15th Avenue, Miami, Florida, legally described in Exhibit "A", attached and incorporated and the approval of Amendment #3 to the construction contract with Link Construction Group, Inc., to include an additional home; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. The allocation of NSP 1 Program Income funds in the amount not to exceed $300,000.00, for the construction of new affordable homes at the City owned sites located at 1477 Northwest 60th Street, 1336 Northwest 60th Street, 5852 Northwest 13th Avenue, and 1497 Northwest 60th Street a/k/a 6005 Northwest 15th Avenue, Miami, Florida, legally described in Exhibit "A", attached and incorporated, and an additional site suitable for building, is authorized. Section 3. The City Manager is authorized {1} to execute Amendment No. 3 to the Construction Contract with Link Group, Inc., in substantially the attached form, for design and construction of single-family infill housing to incude an additional home. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. FOR DESIGN AND CONSTRUCTION OF SINGLE-FAMILY INFILL HOUSING This Amendment No. 3 to Contract 410-2583 dated August 31, 2010 for the design and construction of Single -Family housing between the City of Miami, a municipal corporation of the State of Florida ("CITY"), and Link Construction Group, Inc., a Florida corporation ("Contractor") pursuant to RFP No.: 09-10-009 ("Contract"), is entered into, this day of , 2014. RECITAL WHEREAS, on February 8, 2010 the City issued Request for Proposals No. 09-10-009 Pre -Qualification for Single -Family Infill Housing ("Project" or "RFP"); and WHEREAS, Resolution R-09-0569 authorized the City Manager to approve and execute contracts for the construction of new affordable homes under the City's Neighborhood. Stabilization Program and/or the Neighborhood Initiatives Program of the Liberty City Community Revitalization Trust with Funds awarded to the City from. the United States Department of Housing and Urban Development; and WHEREAS, Amendment No. 1 to the Contract provided, among other things, that the Contractor shall furnish all Design Documents within ninety (90) days of the City's issuance of the Design Work Order; and WHEREAS, Amendment No. 2 further amends the contract by: a) exercising the City's option to extend said Contract for an additional one (1) year period, and b) providing the Contractor with an additional thirty (30) days to furnish all Design Documents; and WHEREAS, This Amendment No. 3, pursuant to Resolution No, R-**-****, passed and adopted by the City of Miami Commission on granted the Contractor additional funds in the amount of ($*******.**) to complete the affordable housing construction at sites [LIST ADDRESSES]; and WHEREAS, Resolution No. R-* *-* * **, granting additional funds in the amount of ($ * * * * * *. * *), also required an additional housing site located within the community of Model City, Miami, FL; and WHEREAS, all the funds are subject to the same terms and conditions contained in the Agreement; NOW, THEREFORE, in consideration of the foregoing, the CITY and CONTRACTOR hereby agree to amend the Agreement as follows: 1, The number of affordable single-family houses to be built under this Agreement has increased from to 2.
