IV 1 L/1 ENFORCEMENT LIYI LI 1 TRUST FUND, AWARD NO. 1169, PROJECT NO. 19-690001, AND ACCOUNT CODE NO. 12500.191602.883000.0000, WITH SUCH EXPENDITURES HAVING BEEN APPROVED BY THE CHIEF OF POLICE AS COMPLYING WITH SECTION 932.7055, FLORIDA STATUTES, AS AMENDED. WHEREAS, Section 932.7055, Florida Statutes, as amended, authorizes the expenditure of forfeiture cash or proceeds for certain law enforcement purposes not considered normal operating expenses; and WHEREAS, City of Miami's ("City's") Police Department, through the Police Athletic League ("PAL"), is committed to the education and development of the youth of our community; and WHEREAS, the program is designed to focus on the prevention of juvenile delinquency and steers youngsters clear of violent and other destructive behaviors through the use of educational and athletic activities; and WHEREAS, as per the request from PAL, the $347,369.35 funding is necessary to keep the doors open and to stave off having to lay off employees until other funds become available; and WHEREAS, a budget was submitted detailing how these funds will be used to cover some expenditures from May 28, 2014 through December 31, 2014; and WHEREAS, funds for this program have not been included in the City's Police Department's normal operating budget and are available in the City's Law Enforcement Trust Fund; and WHEREAS, the Chief of Police has recommended adoption of this resolution and has determined that the expenditures proposed comply with the Section 932.7055, Florida Statutes, as amended; and WHEREAS, pursuant to the provisions of Section 932.7055, Florida Statutes, as amended, the recipient, PAL shall: 1) certify that funds appropriated will be used lawfully and for the purpose stated; 2) maintain proper accounting records for the expenditure of such monies; and, 3) provide any reports, including but not limited to audit reports, as may be required by the City or applicable law; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. The funding of the PAL Program, to assist with expenses related to the operation of the program from May 28, 2014 through December 31, 2014, in an amount not to exceed $347,369.35, is authorized, with funds allocated from the City's Law Enforcement Trust Fund, Award No. 1169, Project No. 19-690001, and Account Code No. 12500.191602.883000.0000, with such expenditures having been approved by the Chief of Police as complying with Section 932.7055, Florida Statutes, as amended. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} APPROVED AS TO FORM AND CORRECTNESS: VICTORIA IViENDEZ 61,4 CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
