HomeMy WebLinkAboutAnalysis, Maps & PZAB Resoami Planning 'and Zoning Department Land Development Section File ID#:14-00331ac ANALYSIS FOR ALLEY CLOSURE Request: Pursuant to Section 55-15 (c) of the Miami City Code, the Planning Department has reviewed the proposed public right-of-way vacation and closure to determine whether it is in the public interest, or whether the general public would benefit from the vacation of the right-of-way. Project: Closing, vacating, abandoning and discontinuing for public use an alley located Location: APPROXIMATELY BETWEEN S. MIAMI AVENUE AND BRICKELL AVENUE, AND BETWEEN SE 13TH STREET AND SE 14TH STREET, MIAMI, FLORIDA Net District: Downtown NET Folio #: NIA Square footage: NIA Current Zoning Designation: N/A FINDINGS AND COMMENTS: 1. The general public does not appear to use the alley for through block access. The utilization by the general public is for access to the abutting commercial buildings. The closure of the alley and unification of the property opens and improves the redevelopment potential for the site. 2. The Solid Waste Department is not utilizing the alley, collection is accomplished by private vendors. The Police Department does not regularly patrol the alley. The alley could potentially be used by the Fire Department depending on the emergency situation. If an access easement is granted by separate instrument, any development of the proposed tracts must be coordinated to avoid creating "dead end" access. 3. There is no specific development intent for the property at this time. The current alley may be utilized by emergency response vehicles and personnel if necessary. Granting of an easement would satisfy access requirements if closely coordinated with redevelopment of the site. 4. The closure and vacation of the alley will eliminate "cut -through" vehicular traffic and improve pedestrian safety. An easement would satisfy access requirements to the adjacent buildings and parking areas. Future development on the site must comply with the Miami 21 Zoning Code which may require an improved, safe public pedestrian access corridor through the block. K. Based on these findings, the Plat and Street Committee reconsidered this vacation and alley closure and the members voted to recommend 5 in favor and 3 in denial of this alley closure request subject to the granting of an access/utility easement to the City, by separate instrument, on the footprint of the former alley with any development of the proposed tracts coordinated to avoid creating a "dead end" access. Based on the above findings, the Planning and Zoning Department recommends Approval of the request. 04/17/2014 K.
