HomeMy WebLinkAboutR-14-0233City of Miami Legislation Resolution: R-14-0233 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00501 Final Action Date: 6/26/2014 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ESTABLISHING A NEW SPECIAL REVENUE PROJECT ENTITLED: "PROGRAMS FOR THE DEVELOPMENTALLY DISABLED 2014-2017," APPROPRIATING FUNDS FOR ITS OPERATION, AND AUTHORIZING THE CITY MANAGER TO ACCEPT A TOTAL AMOUNT OF $505,440.00 IN THE FORM OF ONE (1) REIMBURSEMENT GRANT FROM THE STATE OF FLORIDA AGENCY FOR HEALTH CARE ADMINISTRATION, TO THE CITY OF MIAMI'S DEPARTMENT OF PARKS AND RECREATION FOR THE PROGRAM FOR PERSONS WITH DISABILITIES, TO FUND SERVICES AND PROGRAMS FOR THE DEVELOPMENTALLY DISABLED ADMINISTERED BY THE CITY OF MIAMI'S DEPARTMENT OF PARKS AND RECREATION; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A MEDICAID WAIVER PROVIDER AGREEMENT WITH THE STATE OF FLORIDA AGENCY FOR HEALTH CARE ADMINISTRATION, IN SUBSTANTIALLY THE ATTACHED FORM, AND TO EXECUTE ALL OTHER NECESSARY AMENDMENTS, EXTENSIONS, AND MODIFICATIONS AFTER CONSULTATION WITH THE CITY ATTORNEY, TO IMPLEMENT THE ACCEPTANCE OF AND COMPLIANCE WITH THE GRANT AWARD FOR SAID PURPOSES, FOR THE PERIOD COMMENCING JULY 1, 2014 THROUGH JUNE 30, 2017. WHEREAS, the City of Miami ("City"), through the Department of Parks and Recreation, obtains funds to support its Home and Community -Based Services ("HCBS") and Family and Supported Living ("FSL") programs through the State of Florida Agency for Health Care Administration ("AHCA") for services administered by the Florida Agency for Persons with Disabilities ("APD"); and WHEREAS, AHCA, through APD, is providing funds to the City, on a reimbursement basis, in the estimated amount of $168,480.00 per year, for a three (3) year period commencing July 1, 2014 through June 30, 2017, for HCBS and FSL services and programs provided within the City to developmentally disabled individuals, for an estimated total amount of $505,440.00; and WHEREAS, the City Manager and the Department of Parks and Recreation are requesting for the City Commission to authorize the City Manager to negotiate and execute a new Medicaid Waiver Service Agreement ("Agreement"), in substantially the attached form, for the period of July 1, 2014 through June 30, 2017; NOW THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference incorporated as fully set forth in this Section. Section 2. The following new Special Revenues Project is established and resources are City of Miami Page 1 of 2 File Id: 14-00501 (Version: 11 Printed On: 1/4/2018 File Number: 14-00501 Enactment Number: R-14-0233 appropriated as described below: PROJECT TITLE: Programs for the Developmentally Disabled 2014-2017 RESOURCES: State of Florida Agency for Health Care Administration $505,440.00 Medicaid Program Development through the State of Florida Agency for Persons with Disabilities APPROPRIATION: Programs for the Developmentally Disabled 2014-2017 $505,440.00 Section 3. The City Manager is authorized{1} to accept a total amount of $505,440.00, in the form of one (1) reimbursement grant from ACHA, to the City's Department of Parks and Recreation for the Program for Persons with Disabilities, to fund services and programs for the developmentally disabled administered by the City's Department of Parks and Recreation. Section 4. The City Manager is further authorized{1} to execute the Agreement with ACHA, in substantially the attached form, and to execute all other necessary amendments, extensions, and modifications after consultation with the City Attorney, to implement the acceptance of and compliance with the grant award for said purposes, for the period commencing July 1, 2014 through June 30, 2017. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subjected to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this resolution, it shall become effective immediately upon override of the veto by the City of Miami Commission.
