AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 40,
ARTICLE III, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,
ENTITLED "PERSONNEL/CIVIL SERVICE RULES AND REGULATIONS", MORE
PARTICULARLY BY AMENDING SECTION 40-113(A), TO REQUIRE THAT LEAVES
FOR MILITARY TRAINING DURING AN ANNUAL PERIOD BE IN COMPLIANCE
WITH FLORIDA STATUTE 115.07, AS AMENDED; CONTAINING A SEVERABILITY
CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Civil Service Board, at its regular meeting of October 1, 2013, unanimously voted
to amend Rule 15.9(a), entitled "Military Training Leave" ("Rule"), by revising the language to allow for
leave time equivalent to the provisions of Florida Statute 115.07; and
WHEREAS, it is now necessary to amend Section 40-113(a) of the Code of the City of Miami,
Florida, as amended ("City Code"), to reflect the Civil Service Board's action for said Rule; and
WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable
and in the best interest of the employees of the City to amend said section of the City Code;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. Chapter 40, Article III, Section 40-113(a) of the City Code, is further amended in the
following particulars:{1}
"CHAPTER 40
PERSONNEL
ARTICLE III. CIVIL SERVICE RULES AND REGULATIONS
Sec. 40-113. Military training leave.
(a) All employees of the City of Miami who are either Reserve Officers or Enlisted Personnel in the
Florida state guard, the National Guard, Naval Militia, Marine Corps, Unorganized Militia, U.S. Army
Reserve, U.S. Naval, U.S. Marine Corps Reserve, U.S. Coast Guard Reserve, U.S. Air Force
Reserve, or Officers or Enlisted Personnel in any other class of the militia, shall be entitled to leave of

absence from their respective duties without loss of pay, time, efficiency rating, or Civil Service
Seniority Credits on all days during which they shall be engaged in field or Coast Guard defense
exercises or other training ordered under the provisions of the U.S. Military or Naval Training
Regulations or under the provisions of the Florida state guard or the National Guard; provided that
leaves of absence granted as a matter of legal right under the provisions of this subsection shall not
exceed seventeen consecutive days in any one calendar year. the provisions cited in Florida State
Statute 115.07.

Section 3. If any Section, part of a section, paragraph, clause, phrase or word of this Ordinance
is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective 30 days after final reading and adoption
thereof.{2}

{2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within
(10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall
become effective immediately upon override of the veto by the City Commission.
