HomeMy WebLinkAboutStaff Report and Business Impact StatementPlanning Department Staff Report and Business Impact Statement Fences and walls relating to game courts and infrasturtcture facilities Purpose: Amendments to the City of Miami Zoning Code to allow additional wall and fence height up to thirteen feet for the purpose of enclosing game courts used for playing basketball, tennis, paddleball, volleyball, or other similar recreational activities. The intended outcome is to facilitate modern recreational activities and encourage outdoor living. The amendments also clarify the maximum height for walls and fences enclosing infrastructure and utilities uses. The proposal to requirements perimeter landscape and architectural treatment is intended to mitigate any visual or ambient effects. Estimated Direct Economic Impact: • The amendment will allow property owners and businesses to erect appropriately designed fences and walls used to enclose game courts and infrastructure facilities. It does not alter the existing land use regulations. • The amendment will enact a By Right provision for Game Court perimeter fences and walls and clarify an existing Warrant process for infrastructure facilities perimeter fences and walls for Businesses will not incur additional cost or require an additional entitlement process. • No direct additional municipality regulatory costs, revenues or fees. Routine reviewing of building permit applications and code compliance activities in respect of enforcing the Miami 21 Zoning Code will continue to apply to projects incorporating fences and walls, as existing. Estimated Number of Businesses to be Impacted: There are approximately eight commercially operating paddleball businesses in the City of Miami. Paddleball courts require additional fence height to play the sport (this amendment). Any existing or future recreational businesses making use of game courts in their operation may require higher fences and walls. As such, they may also benefit from this amendment. Florida Power and Light (FPL) are the principal providers of infrastructure facilities and would benefit from the amendment. All businesses operating in proximity to game courts or infrastructure facilities would benefit from them being appropriately screened by landscape and/or architectural treatment.
