APPLICANT(S): Arthur Noriega V, City Manager on behalf of the City of Miami
PURPOSE: Amendments to the City of Miami Zoning Code to allow additional wall and fence
height necessary to enclose game courts used for playing basketball, tennis, paddleball,
volleyball, or other similar recreational activities and require a perimeter landscape buffer to
mitigate any visual or ambient effects. The amendments also clarify the maximum height for
walls and fences relating to infrastructure and utilities uses.

WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114
as the Zoning Ordinance of the City of Miami, Florida, which has been amended from time to
time ("Miami 21 Code"); and
WHEREAS, the guiding principles of the Miami 21 Code include that architecture and
landscape design should grow from local climate, topography, history, and building practice, and
those buildings should allow their inhabitants to experience the geography and climate through
energy efficient design; and
WHEREAS, an amendment is necessary to allow additional fence and wall height
required to enclose game courts used for playing basketball, tennis, paddleball, volleyball, or
other similar recreational activities; and
WHEREAS, the provision of a perimeter landscape Buffer will assist to mitigate any
visual and ambient impacts on the surrounding neighborhood; and
WHEREAS, an amendment to the Miami 21 Code is also necessary to clarify the
maximum height for walls and fences relating to infrastructure and utilities uses; and
WHEREAS, on July 17, 2024, at a duly notice public meeting, the Planning, Zoning and
Appeals Board ("PZAB") considered the application for the zoning text change, item PZAB.5,
and passed PZAB-R-24-052, recommending approval, by a vote of six to one (6-1); and
WHEREAS, consideration has been given to the need and justification for the proposed
text amendment, including changed or changing conditions that make the passage of the
proposed text amendment necessary; and

WHEREAS, consideration has been given to the relationship of the proposed text
amendment to the goals, objectives, and policies of the Miami Comprehensive Neighborhood
Plan, the Miami 21 Code, and other City regulations;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Article 1 of the Miami 21 Code is further amended in the following
particulars:'
"ARTICLE 1. DEFINITIONS
1.2 DEFINITIONS OF TERMS
Gallery: A covered pedestrian area adjoining the side of a Building on any floor, which may
provide access along one or more sides. See Article 4, Table 7.
Game Court: a spatially defined surface, paved or unpaved, used for playing basketball, tennis,
paddleball, volleyball, or other similar recreational activities
Section 3. Article 5 of the Miami 21 Code is further amended in the following
particulars:2
"ARTICLE 5. SPECIFIC TO ZONES
SECTION 5.3.2 Building Configuration (T3)
8. Fences and walls may be located up to and including the Frontage Line to the following
maximum Height. Height of fences and walls shall not exceed four (4) feet within the
First Layer, except aluminum or iron picket and post Fences with or without masonry
posts shall not exceed six (6) feet. Within the Second and Third Layers, Fences and
walls shall not exceed eight (8) feet. Notwithstanding the above, walls and fences
enclosing outdoor Game Courts may extend up to a maximum height of thirteen feet
(13') and shall:

a. comply with the underlying Setbacks for Outbuildings; and
b. be transparent; and
c. be screened by a perimeter landscape Buffer along the sides and rear of the
minimum height, length and depth necessary to conceal them and mitigate any
ambient impacts.
SECTION 5.4.2 Building Configuration (T4)
9. Fences and walls may be located at the Frontage Line as shown in Article 4, Table 6.
Fences and walls shall be a maximum Height of four (4) feet at the First Layer, except
aluminum or iron picket and post Fences with or without masonry posts shall not exceed
six (6) feet. Within the Second and Third Layers, Fences and walls shall be a maximum
Height of eight (8) feet. Notwithstanding the above, walls and fences enclosing outdoor
Game Courts may extend up to a maximum height of thirteen feet (13') and shall:
a. comply with the underlying Setbacks for Outbuildings; and
b. be transparent; and
c. be screened by a perimeter landscape Buffer along the sides and rear of the
minimum height, length and depth necessary to conceal them and mitigate any
ambient impacts.
SECTION 5.5.2 Building Configuration (T5)
10. Within the Second and Third Layers, fences and walls shall not exceed a Height of eight
(8) feet. Existing or permitted Single -Family Residences and Two -Family Housing as of
the effective date of this amendment to the Miami 21 Code may utilize the standards
applicable to fences and walls in the T3 Transect Zone provided that such Use is the
only Use on the Lot and that any such fence and wall erected or maintained pursuant to
this subsection be removed upon any other change of Use. Notwithstanding the above,
fences and walls not exceeding a height of eight (8) feet, may be located within the First
Layer in connection with Uses that solely serve needs of neighborhood children and are
affiliated with an abutting approved Rescue Mission provided said fences and walls be
designed with architectural treatment and landscaping that mitigates and enhances their
appearance; harmonizes with the architecture of the facility and neighborhood character;
and complies with Article 4, Table 12 Design Review Criteria, as applicable.
Notwithstanding the above, walls and fences enclosing outdoor Game Courts may
extend up to a maximum height of thirteen feet (13') and shall:
a. comply with the underlying Principal Building Setbacks; and
b. be transparent; and
c. be screened by a perimeter landscape Buffer along the sides and rear of the
minimum height, length and depth necessary to conceal them and mitigate any
ambient impacts.

SECTION 5.6.2 Building Configuration (T6)
k. Within the Second and Third Layers, fences and walls shall not exceed a Height of eight
(8) feet. Existing or permitted Single -Family Residences andTwo-Family Housing as of
the effective date of this amendment to the Miami 21 Code may utilize the standards
applicable to fences and walls in the T3 Transect Zone provided that such Use is the
only Use on the Lot and that any such fence and wall erected or maintained pursuant to
this subsection be removed upon any other change of Use. Notwithstanding the above,
walls and fences enclosing outdoor Game Courts may extend up to a maximum height
of thirteen feet (13') and shall:
a. comply with the underlying Principal Building Setbacks; and
b. be transparent; and
c. be screened by a perimeter landscape Buffer along the sides and rear of the
minimum height, length and depth necessary to conceal them and mitigate any
ambient impacts.
SECTION 5.8.2 Building Configuration (CI -HD)
h. Within the Second and Third Layers, Fences and walls shall not exceed a Height of eight
(8) feet. Major Facilities requiring additional Fence or wall Height may be permitted by
Waiver, subject to the Planning Director's agreement that the applicant has
demonstrated that the Use specifically requires the proposed additional Height.
Notwithstanding the above, walls and fences enclosing outdoor Game Courts may
extend up to a maximum height of thirteen feet (13') and shall:
a. comply with the underlying Principal Building Setbacks; and
b. be transparent; and
c. be screened by a perimeter landscape Buffer along the sides and rear of the
minimum height, length and depth necessary to conceal them and mitigate any
ambient impacts.
SECTION 5.9.2 Building Configuration (D)
h. Streetscreens shall be between three and a half (3.5) and eight (8) feet in Height. The
Streetscreen may be replaced by a hedge or fence. Streetscreens shall have openings
no larger than necessary to allow automobile and pedestrian access. Fences and walls
within the First, Second, and Third Layers shall not exceed a Height of eight (8) feet.
Notwithstanding the above, walls and fences enclosing outdoor Game Courts may
extend up to a maximum height of thirteen feet (13') and shall:
a. comply with the underlying Principal Building Setbacks; and
b. be transparent; and

minimum height, length and depth necessary to conceal them and mitigate any
ambient impacts.

Section 5. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance should not be affected.
Section 6. It is the intention that the provisions of this Ordinance shall become and be
made a part of the Miami 21 Code, which provisions may be renumbered or re -lettered and that
the word "Ordinance" may be changed to "Section," "Article," or other appropriate word to
accomplish such intention.
Section 7. This Ordinance shall become effective upon ten (10) days after adoption
thereof.4
