Hannon City Clerk Henry Torre, Director Department of Public Fabilities DATE: SUBJECT: May 2, 2014 FILE : Purchase of properties at 602 and 614 South Miami Avenue, Miami, FL REFERENCES: ENCLOSURES: Enclosed you will find an ad for notice of a public hearing to be held by the City Commission on May 22, 2014, for the purpose of authorizing the City Manager to execute a Contract for Sale and Purchase ("Agreement"), between the City of Miami ("Purchaser") and the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida ("Seller") for the acquisition of the properties located at 602 South Miami Avenue and 614 South Miami Avenue, (collectively the "Property"). Please place the ad in accordance with public hearing requirements of the City Commission. Thank you for your assistance in this matter. Approved: `5,a1}`-k Agenda Coordinator Enclosure HT:AB: Purchase of properties 602 and 614 South Miami Avenue CITY OF MIAMI, FLORIDA NOTICE OF PUBLIC HEARING A public hearing will be held by the City Commission of the City of Miami, Florida on May 22, 2014, at 9:00 A.M. at City Hall, located at 3500 Pan American Drive, Miami, Florida, for the purpose of granting the following: A RESOLUTION OF THE MIAMI CITY COMMISSION, AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT FOR SALE AND PURCHASE ("AGREEMENT") BETWEEN THE CITY OF MIAMI ("PURCHASER") AND THE BOARD OF TRUSTEES OF THE INTERNAL IMPROVEMENT TRUST FUND OF THE STATE OF FLORIDA ("SELLER") FOR THE ACQUISITION OF THE PROPERTIES LOCATED AT 602 SOUTH MIAMI AVENUE AND 614 SOUTH MIAMI AVENUE, MIAMI, FLORIDA (COLLECTIVELY THE "PROPERTY"), AS LEGALLY DESCRIBED IN THE AGREEMENT, IN CONNECTION WITH THE TRAFFIC IMPROVEMENT AT 6TH STREET AND MIAMI AVENUE PROJECT FOR A TOTAL PURCHASE PRICE OF FOUR MILLION SEVEN HUNDRED THOUSAND DOLLARS ($4,700,000) AND TO FINALIZE THE TRANSACTION IN ACCORDANCE WITH THE TERMS OF THE AGREEMENT; ALLOCATING FUNDS, AT A TOTAL AMOUNT NOT TO EXCEED FOUR MILLION EIGHT HUNDRED SIXTY FIVE THOUSAND DOLLARS ($4,865,000) FROM THE FOLLOWING FUNDING SOURCES: (I) THE DONATION MADE BY BCC ROAD IMPROVEMENT, LLC., ("BCC") UNDER RESOLUTION 14- IN THE AMOUNT OF FOUR MILLION ONE HUNDRED SIXTY FIVE THOUSAND DOLLARS ($4,165,000); AND (II) SEVEN HUNDRED THOUSAND DOLLARS ($700,000) FROM 6TH STREET EASEMENT FEES MADE BY SWIRE PROPERTIES, INC., TO COVER THE COSTS ASSOCIATED WITH THE ACQUISITION OF THE PROPERTY, INCLUDING BUT NOT LIMITED TO SURVEYS, ENVIRONMENTAL REPORTS, AND TITLE INSURANCE; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO ACCOMPLISH THE ACQUISITION OF THE PROPERTY. All interested persons are invited to appear and may be heard concerning these items. Should any person desire to appeal any decision of the City Commission with respect to any matter considered at this hearing, that person shall ensure that a verbatim record of the proceedings is made, including all testimony and evidence upon any appeal may be based (F.S. 286.0105).
