HomeMy WebLinkAboutR-14-0201City of Miami Legislation Resolution: R-14-0201 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-13-01437 Final Action Date: 5/22/2014 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ACCEPTING THE BID RECEIVED DECEMBER 18, 2013, PURSUANT TO INVITATION TO BID ("ITB") NO. 13-14-002, FROM WEST CONSTRUCTION, INC., THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER, FOR AFRICAN SQUARE PARK IMPROVEMENTS AND RENOVATIONS/ SPLASH PARK PROJECT, FORA TOTAL NOT TO EXCEED AWARD VALUE OF $559,918.70, WHICH INCLUDES $494,017.00 FOR THE TOTAL BASE BID AMOUNT AND AN ALLOWANCE OF $15,000.00 FOR PERMIT FEES, PLUS ATEN PERCENT (10%) OWNER CONTINGENCY AMOUNT OF $50,901.70; APPROVING AN ASPIRATIONAL GOAL REQUIRING THAT FIFTY PERCENT (50%) OF THE REQUIRED FIFTEEN PERCENT (15%) LOCAL WORKFORCE PARTICIPATION BE FULFILLED BY RESIDENTS FROM COMMISSION DISTRICT 5; ALLOCATING FUNDS IN THE AMOUNT OF $559,918.70, FROM CAPITAL IMPROVEMENT PROJECT NO. B-30882; AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT, IN SUBSTANTIALLY THE ATTACHED FORM, CONSISTING OF THE ITB DOCUMENTS AND ATTACHMENTS, FOR SAID PURPOSE. WHEREAS, the Capital Improvements and Transportation Program ("CIP") issued Invitation to Bid ("ITB") No. 13-14-002 for construction services for African Square Park Improvements and Renovations/Splash Park, Project No. B-30882 ("Project"); and WHEREAS, nine (9) bids were received by the Office of the City Clerk on December 18, 2013; and WHEREAS, CIP has determined West Construction, Inc. ("West"), to be the lowest responsive and responsible bidder; and WHEREAS, the City Manager requests authorization to execute a contract with West for a total not to exceed award value of $559,918.70, which includes $494,017.00 for the total base bid, and an allowance of $15,000.00 for permit fees, plus a ten percent (10%) owner contingency amount of $50,901.70; and WHEREAS, funds in the amount of $559,918.70 are to be allocated from Capital Improvement Project No. B-30882; and WHEREAS, the City Commission desires to establish an aspirational goal requiring that fifty percent (50%) of the required fifteen percent (15%) local workforce participation be fulfilled by residents from City Commission District 5; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File Id: 14-13-01437 (Version: 21 Printed On: 1/3/2018 File Number: 14-13-01437 Enactment Number: R-14-0201 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The bid received December 18, 2013, pursuant to ITB No. 13-14-002, from West, the lowest responsive and responsible bidder, for the Project, in the amount of $494,017.00 which includes $494,017.00 for the total base bid, and an allowance of $15,000.00 for permit fees, plus a ten percent (10%) owner contingency amount of $50,901.70, for a total not to exceed award value of $559,918.70, is accepted, with funds in the amount of $559,918.70, allocated from Capital Improvement Project No. B-30882. Section3. The City Commission hereby establishes an aspirational goal requiring that fifty percent (50%) of the required fifteen percent (15%) local workforce participation be fulfilled by residents from City Commission District 5. Section 4. The City Manager is authorized {1} to execute a Contract, in substantially the attached form, consisting of the ITB documents and attachments, for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited, to those prescribed by applicable City Charter and City Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
