A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE
EXPENDITURE OF ADDITIONAL ATTORNEY'S FEES AND COSTS, IN THE
AMOUNT OF $133,019.42, FOR THE CONTINUED ENGAGEMENT OF THOMAS
SCOTT, ESQ., OF THE LAW FIRM OF COLE, SCOTT & KISSANE, FOR
REPRESENTATION OF THE CITY OF MIAMI, IN THE MODIFICATION
PROCEEDINGS BROUGHT IN THE CASE OF MICHAEL POTTINGER, ET AL. VS.
CITY OF MIAMI, IN THE UNITED STATES DISTRICT COURT, CASE NO,:
88-2406-CIV-MORENO, WITH SAID FUNDS ALLOCATED FROM THE NON
DEPARTMENTAL ACCOUNT NO. 00001.980000.531010,0000.00000.
WHEREAS, pursuant to Resolution No. 13-0135, adopted April 11, 2013, the City Commission
authorized the expenditure of attorney's fees and costs in the amount of $75,000.00, for the
engagement of Thomas Scott, Esq., of the Law Firm of Cole, Scott & Kissane, for the representation
of the City of Miami in the modification proceedings brought in the case of Michael Pottinger vs. City of
Miami, in the United States District Court, Southern District of Florida, Case No.: 88-
2406-CIV-MORENO, with said funds allocated by the Downtown Development Authority ("DDA"),
subject to DDA approval; and
WHEREAS, the DDA approved the expenditure, and the funds authorized have been expended
and exhausted; and
WHEREAS, the expenditure of additional attorney's fees and costs, above $75,000.00, are
necessary;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section
Section 2. The expenditure of additional attorney's fees and costs, in the amount of $133,019.42,
for the continued engagement of Thomas Scott, Esq., of the Law Firm of Cole, Scott & Kissane, for the
representation of the City of Miami in the modification proceedings in the case of Michael Pottinger vs.
City of Miami, in the United States District Court, Southern District of Florida, Case No.; 88-
2406-CIV-IV1ORENO, is authorized, with said funds allocated from the Non Departrnental Account No.
00001.980000.531010.0000.00000.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the 11/layor.{1}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
