Background Information: The City Commission adopted Resolution No. R-13-0219 (see Attachment "A") on June 13, 2013 for the City to assume jurisdictional responsibility, maintenance and control of Brickell Avenue with the condition that the City will transfer certain streets from the City Street System to the Department State Highway System at a future date. The Capital Improvements/Transportation Office and the Public Works Department have completed a citywide analysis of potential roadway transfers and have identified several corridors for transfer between governmental jurisdictions.(see Attachment "B") It is recommended to transfer portions of NW 14 St. and NW 3 Ave. from the City Street System to the Department State Highway System, as requested by FDOT. WHEREAS, the Florida Department of Transportation ("Department") has completed a countywide analysis of potential roadway transfers and has identified corridors for possible transfer between governmental jurisdictions; and WHEREAS, the City of Miami ("City") desires to assume jurisdictional responsibility for Brickell Avenue from I-95 to Southwest 8 Street, Miami, Florida; and WHEREAS, the City will request the transfer of additional streets from the City Street System to the State of Florida Department of Transportation State Highway System by mutual agreement, and a subsequent Roadway Transfer Agreement, to be determined by September 30, 2013; and WHEREAS, the City agrees with the terms and conditions contained in the Agreement, and these transfers are mutually agreed upon between the City and the Department; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized (1 ) to execute the Roadway Transfer Agreement, in substantially the attached form, with the Department, for the transfer of State Road 5/US-1/Brickell Avenue, Miami, Florida, from State Road 9/1-95 to State Road 90/Southwest 8 Street, Miami, Florida, from the Department State Highway System to the City Street System. Section 3. The City Manager is further authorized (1 ) to execute all other agreements, permits and any other relevant documents that may be required to effectuate the transfer. As you are aware, the Department is agreeable to accepting NW 3rd Avenue (Flagler to NW 8 St/on-ramp I-95). In addition, we propose a segment of NW 14th Street. Both roadways are highlighted in the attached table. At this time, the Department does not identify any new information to warrant acceptance of the below identified roadways. As you may be aware, these roads serve primarily residential areas, with shorter distance local trips that are distributed between local streets and arterial roadways. These low volume/local trip roadways are not characteristic of the State Highway System and are also inconsistent with PPM Standards. • NW 11 STREET (NW 27 Ave — NW 42 Ave) • NW 2 Avenue (NW 36 St — NW 79 St) • SW 32 Avenue (Coral Way —South Dixie Highway) If the City is agreeable with the proposal for NW 3rd Avenue and NW 14th Street, please let me know, and I will begin developing the transfer agreement. It appears that there is no discernible reference to 1 multi-lane/four lane roadways as a specific criteria. The referenced Florida Statute 335.0415 states that transfers of roadways to and from the State Highway System are based on the following general criteria: a. National defense needs b. Travel to and through urban areas c. Access to intermodal facilities d. Access to regional public facilities e. Disaster preparedness and emergency evacuation And per the current Functional Classification Map obtained from your office, it appears that state roads within the City of Miami limits are currently classified as Urban Principal Arterial or Urban Minor Arterial. The following roadways that we have offered to the State are consistent with such classification, provide connectivity to existing State roadways, as well as comply with the criteria set forth in F.S. 335.0415: • NW 3 Avenue (Flagler St - NW 8 ST/on-ramp to 1-95) Multi -lane, Urban Major Collector • NW 11 STREET (NW 27 Ave — NW 42 Ave) Two-lane, Urban Major Collector • NW 2 Avenue (NW 36 St— NW 79 St) Two-lane, Urban Major Collector • SW 32 Avenue (Coral Way —South Dixie Highway) Two-lane, Urban Major Collector Further, we are aware that a number of roadways in the Miami -Dade area that are under the State Highway System are not necessarily multi-lane/four lane corridors. Specifically, Krome Avenue (Unincorporated), NW 57th Avenue (in City of West Miami), and State Road 7, NW/SW 8 Avenue between NW 4 St and SW 8 St (in City of Miami) are two-lane roadways under the State Highway System. Consistent with the established criteria, as set forth in F.S. 335.0415, which your office has graciously referred us to, and the fact that certain other state roads in Miami -Dade County are currently two -lanes, we respectfully request your reconsideration of our offer and to accept the aforesaid roadways from the City of Miami. We await your affirmative response to enable us proceed with appropriate legislation for the transfer process. Thanks. The analysis showed that most major 4 lane roads within the City are under the jurisdiction of Miami -Dade County. The few remaining 4 lane City roadways did not meet the guidelines and criteria for functional classification as State highways, and therefore are not good candidates for transfer to FDOT.
