A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING A GRANT ALLOCATION FROM THE UNITED STATES CONGRESS
AND ADMINISTERED BY THE UNITED STATES DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT ("HUD"), ECONOMIC DEVELOPMENT INITIATIVE
COMMUNITY PROJECT FUNDING ("EDI-CPF") FOR THE 2024 FISCAL YEAR ("FY
2024 ACT"), IN THE AMOUNT OF THREE MILLION, FIVE HUNDRED THOUSAND
DOLLARS ($3,500,000.00), TO FUND THE FLAGLER AFFORDABLE SENIOR
HOUSING PROJECT ("PROJECT"), MANAGED BY THE CITY OF MIAMI
DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT; FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL
NECESSARY DOCUMENTS INCLUDING AMENDMENTS, RENEWALS,
EXTENSIONS, AND MODIFICATIONS, ALL IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, AS MAY BE NECESSARY FOR SAID PURPOSE, SUBJECT TO ALL
FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH

URBAN DEVELOPMENT ("HUD"), ECONOMIC DEVELOPMENT INITIATIVE
COMMUNITY PROJECT FUNDING ("EDI-CPF") FOR THE 2024 FISCAL YEAR ("FY
2024 ACT"), IN THE AMOUNT OF THREE MILLION, FIVE HUNDRED THOUSAND

HOUSING PROJECT ("PROJECT"), MANAGED BY THE CITY OF MIAMI

AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL

EXTENSIONS, AND MODIFICATIONS, ALL IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, AS MAY BE NECESSARY FOR SAID PURPOSE, SUBJECT TO ALL
FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH
FUNDS.
WHEREAS, the Consolidated Appropriations Act, 2024, and the Further Consolidated
Appropriations Act, 2024, ("the FY 2024 Acts") provided $3,290,054,336 in Economic
Development Initiative ("EDI") funding for the purpose of making Community Project Funding
("CPF") available; and
WHEREAS, the City of Miami ("City") submitted a grant application to the United States
Department of Housing and Urban Development ("HUD") to increase the availability of
affordable housing for low-income seniors; and
WHEREAS, on August 27, 2024, the City of Miami ("City") received a notification from
the United States Department of Housing and Urban Development ("HUD") awarding a grant
allocation to the City of Miami ("City"), in the total amount of Three Million Five Hundred
Thousand and 00/100 Dollars ($3,500,000.00) for the Flagler Affordable Senior Housing Project
located at 5215 West Flagler Street ("Project"); and
WHEREAS, the grant allocation will be used for construction costs associated with the
Project and managed by the City's Department of Housing and Community Development; and
WHEREAS, the City's Administration recommends the acceptance of EDI-CPF grant
funds from the FY 2024 Act in the amount of Three Million Five Hundred Thousand and 00/100
Dollars ($3,500,000.00) to be used for the construction costs of Project.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The acceptance of EDI-CPF grant funds from the FY 2024 Act in the amount
of Three Million Five Hundred Thousand and 00/100 Dollars ($3,500,000.00) to fund the Flagler
Affordable Senior Housing Project, is authorized.'
Section 3. The City Manager is authorized to negotiate and execute any and all
documents, in a form acceptable to the City Attorney, as may be necessary for said purpose,
subject to all federal, state, and local laws that regulate the use of such funds.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature by the Mayor.2
APPROVED AS TO FORM AND CORRECTNESS:
The herein authorization is further subject to compliance with all legal requirements that may be imposed,
including but not limited to those prescribed by applicable City Charter and City Code provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
