HomeMy WebLinkAboutR-14-0166City of Miami Legislation Resolution: R-14-0166 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00370a Final Action Date: 4/24/2014 A RESOLUTION OF THE MIAMI CITY COMMISSION AFFIRMATIVELY SUPPORTING THE ULTRA MUSIC FESTIVAL IN BAYFRONT PARK, SUBJECT TO THE ORIGINAL AGREEMENT AND THE NEW CONDITIONS SET FORTH IN THIS RESOLUTION AFFIRMING THESE CONDITIONS AS AGREED TO BY ULTRA REPRESENTATIVES; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE BAYFRONT PARK MANAGEMENT TRUST. WHEREAS, the Ultra Music Festival ("Ultra") has been held since and will be held annually in Bayfront Park, under current agreement until 2018 subject to conditions, located in Downtown Miami; and WHEREAS, on April 24, 2014, the Miami City Commission held a discussion regarding various public health, safety, general welfare, and quality of life concerns relative to Ultra which was a public hearing item; and WHEREAS, the current Ultra Use Agreement ("Agreement") includes a use period from March , 2014 through March, 2018 during the dates specified in the Agreement; and WHEREAS, the City Commission heard from members of the public, local residents and businesses, school and police officials, and representatives of Ultra; and WHEREAS, the City Commission hereby ratifies the prior Ultra Use Agreements approved by the Bayfront Park Management Trust; and WHEREAS, Ultra representatives, Mr. Brian May and Mr. Angel Cortinas, Esq. proffered and accepted various conditions on the record including but not limited to those conditions listed in Section 2 of this Resolution, and agreed at the public hearing to such conditions; and WHEREAS, the Miami City Commission affirmatively supports Ultra in Bayfront Park subject to implementation and adherence of the measures set forth as conditions in this Resolution; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The Miami City Commission affirmatively supports Ultra in Bayfront Park, subject to the following conditions which are to be satisfactorily addressed by the owners and management of Ultra: a. Ultra has retained retiring City of Miami Beach Police Chief Ray Martinez as its Chief of Security. Security Chief Martinez will implement and maintain a direct line of communication as to all public safety, security, and law enforcement measures with the City of Miami Police City of Miami Page 1 of 2 File Id: 14-00370a (Version: 1) Printed On: 12/27/2017 File Number: 14-00370a Enactment Number: R-14-0166 and Fire Departments, to address all such concerns, solutions, and measures relative to these issues before, during, and after Ultra (sometimes referred to as the event); b. Additional City of Miami law enforcement officers will be deployed to secure and staff the perimeter of the event, including, without limitation, having guarded posts staffed by law enforcement officers, preventing gate crashers in an adequate assignment of law enforcement officers as determined by the City Police Chief, in order to successfully implement these measures; c. Double G-8 Fencing will be placed in all critical areas around the perimeter of the event to provide greater spacing between fencing layers in order to prevent gate crashers, including giving due consideration to establishing one or more "no ticket zones"; d. Mental health, alcohol, and substance (i.e. drug) abuse assistance stations will remain open throughout the event; e. The weather and wind speeds will be constantly monitored and the event will be shut down any time the wind speed exceeds 35 miles per hour; f. Ultra will take a public stance opposing any drug use, alcohol use, and any substance abuse at the event and will oppose any lewd and lascivious conduct at the event which is offensive to the morals of the community; g. Ultra will establish known (i.e. publicized) lines of communication, including a contact person or persons for local businesses and residents and will assist with a law enforcement "hotline" for the event. Section 3. The City Attorney is authorized to draft a Memorandum of Understanding setting forth these conditions to be signed by an authorized representative of Ultra and the City Manager as an administrative matter. Section 4. The City Clerk is hereby directed to transmit a copy of this Resolution to the Bayfront Park Management Trust. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
