HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00280 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A UNITY OF TITLE, IN SUBSTANTIALLY THE ATTACHED FORM, FOR THREE (3) CITY OF MIAMI-OWNED PARCELS LOCATED AT 1300 SOUTHWEST 12TH AVENUE, 1320 SOUTHWEST 12TH AVENUE AND 1330 SOUTHWEST 12TH AVENUE, MIAMI, FLORIDA, AS DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED, WITH TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN SAID UNITY OF TITLE; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY OTHER NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, the Coral Way Community Center Playground Project has been incorporated into the City of Miami's ("City's") Capital Improvement and Transportation Program and Multi -year Plan as Project No. B-30365Q, CD Project No. 91-03275, entitled "Coral Way Community Center Playground" ("Project"); and WHEREAS, the City is the owner of three (3) parcels of real property located at 1300 Southwest 12th Avenue, 1320 Southwest 12th Avenue and 1330 Southwest 12th Avenue, Miami, Florida and more particularly described in Exhibit "A", attached and incorporated; and WHEREAS, the City desires to unite these three (3) parcels in order to obtain construction permits necessary for the construction of the Project; and WHEREAS, pursuant to the Section 7.1.7.1 of the Miami 21 Zoning Code, in order to obtain the necessary approvals from the Planning and Zoning Department, the Building Department, and other permitting agencies to connect these parcels as one (1) site, the execution of a Unity of Title is required and shall be filed as a permanent part of public records of Miami -Dade County; and WHEREAS, the Unity of Title is to run with the land and shall be binding on all parties, and all persons claiming under it for a period of thirty (30) years from the date this Unity of Title is recorded, after which time it shall be extended automatically for successive periods of ten (10) years each, with terms and conditions as more particularly set forth in said Unity of Title; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a Unity of Title, in substantially the attached form, for the use of three (3) City -owned parcels of land located at 1300 Southwest 12th Avenue, 1320 Southwest 12th Avenue and 1330 Southwest 12th Avenue, Miami, Florida, as described in "Exhibit A", attached and incorporated, with terms and conditions as more particularly set forth in City of Miami Page 1 of 2 File Id: 14-00280 (Version: 1) Printed On: 4/7/2014 File Number: 14-00280 said Unity of Title. Section 3. The City Manager is further authorized{1} to execute any in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS: � 1 VICTORIA MENDEZ CITY ATTORNEY other necessary documents, its adoption and signature of Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
