HomeMy WebLinkAboutMemo - Office of the City Attorney;CITY OF MIAMI OFFICE OF THE CITY ATTORNEY MEMORANDUM TO: Honorable Mayor and Members of t•ie Cit ,Coln rrs'on FROM: Victoria Mendez, City Attorney L.3) DATE: April 14, 2013 RE: Proposed Resolution for City Commission Meeting — April 24, 2014 Authorizing the City Manager to execute a Settlement Agreement File No. 14-00380 The attached proposed Resolution is being presented for consideration at the April 24, 2014 City Commission meeting. The City Attorney recommends the City Commission adopt this Resolution and authorize the City Manager to execute the attached Settlement Agreement which is in the best interests of the City and its residents. This Settlement Agreement will amicably conclude and resolve litigation brought under the Americans with Disabilities Act relating to communication of information to users of the trolley system owned by the City of Miami ("City"). A suit was brought by a trolley user with refractive amblyiopia and macular atrophy, significant vision impairments. The company that operates the trolley system on the City's behalf is Limousines of South Florida, Inc. They were also sued. The Agreement calls for Limousines of South Florida, to pay costs, attorneys fees and damages to Plaintiff. They are also required to monitor the performance of their employees in communicating information to riders. The City has agreed to install a pre-recorded stop announcement system on all trolleys by December 31, 2014. The City will not pay any costs, fees or damages. c: Daniel J.
