HomeMy WebLinkAboutR-14-0137City of Miami Legislation Resolution: R-14-0137 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00226 Final Action Date: 4/10/2014 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BYA FOUR -FIFTHS (4/STHS), AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND AUTHORIZING THE PURCHASE OF THE SHOTSPOTTER FLEX GUNFIRE LOCATOR SYSTEM, FROM SHOTSPOTTER, INC., FOR THE DEPARTMENT OF POLICE, AT A TOTAL FIRST YEAR COST OF $275,000.00; ALLOCATING FUNDS FOR THE FIRST YEAR, IN THE AMOUNT OF $200,000.00 FROM THE LAW ENFORCEMENT TRUST FUND, AWARD NO. 1171, PROJECT NO. 19-690003, AND ACCOUNT CODE NO. 12500.191602.664000.0.0 AND THE AMOUNT OF $75,000.00 FROM COMMUNITY REDEVELOPMENT AGENCY ACCOUNT NO. 10050.920101.883000.0000.00000; ALLOCATING FUNDS FOR FUTURE ANNUAL SUBSCRIPTION FEES IN THE AMOUNT OF $185,000.00, FROM THE VARIOUS SOURCES OF FUNDS, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE DOCUMENTS, IN SUBSTANTIALLY THE ATTACHED FORM, AND ANY NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 13-0218, adopted June 13, 2013, the Miami City Commission directed the City Manager to undertake actions necessary to procure and implement a Gunfire Locator System in the City of Miami ("City"), in particular, a four (4) square mile area including, one (1) square mile in Overtown, two (2) square miles in Liberty City and one (1) square mile in Little Haiti; and WHEREAS, acting upon this directive, the City's Police Department is seeking to purchase the ShotSpotter Flex Gunfire Locator System; and WHEREAS, ShotSpotter, Inc. is the exclusive provider of ShotSpotter Flex, the cloud -based, subscription managed service offering which includes warranty, repair, maintenance and support services on all of its systems; and WHEREAS, this wide -area system uses acoustic sensing technology protected by twenty-seven (27) unique and current patents to identify, discriminate, record and locate gunshots and other explosive events to law enforcement and police departments within seconds of the shots being fired; and WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as amended ("City Code"), the Chief Procurement Officer has adopted a finding that ShotSpotter, Inc. is the sole -source provider of the ShotSpotter Flex Gunfire Locator System; and City of Miami Page 1 of 2 File Id: 14-00226 (Version: 1) Printed On: 12/26/2017 File Number: 14-00226 Enactment Number: R-14-0137 WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Chief Procurement recommend that the requirements for competitive sealed bidding procedures be waived and that the procurement of the ShotSpotter Flex Gunfire Locator System from ShotSpotter, Inc., as a sole source, be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. By a four -fifths (4/5ths), affirmative vote, pursuant to Section 18-92 of the City Code, after an advertised public hearing, the City Manager's finding of a sole source, is ratified, approved and confirmed, the requirements for competitive sealed bidding procedures are waived, and the purchase of the ShotSpotter Flex Gunfire Locator System, from ShotSpotter, Inc., for the Department of Police, is approved, for a total first year cost of $275,000.00, with funds allocated for the first year, in the amount of $200,000.00 from the Law Enforcement Trust Fund, Award No. 1171, Project No. 19-690003, and Account Code No. 12500.191602.664000.0.0 and the amount of $75,000.00 from the Community Redevelopment Agency Account No. 10050.920101.883000.0000.00000, with funds allocated for future annual subscription fees in the amount of $185,000.00, from the various sources of funds, subject to the availability of funds and budgetary approval at the time of need. Section 3. The City Manager is authorized{1} to execute the documents, in substantially the attached form, and any necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and the signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
