A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A MUTUAL AID AGREEMENT,
IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND
NORTH BAY VILLAGE, TO RECEIVE AND EXTEND MUTUAL AID IN THE FORM
OF LAW ENFORCEMENT SERVICES AND RESOURCES TO ENSURE PUBLIC
SAFETY AND ADEQUATELY RESPOND TO SITUATIONS, INCLUDING, BUT NOT
LIMITED TO NATURAL AND MANMADE DISASTERS OR EMERGENCIES AS
DEFINED IN CHAPTER 23, PART 1, OF THE FLORIDA STATUTES.
WHEREAS, because of the existing and continuing possibility of the occurrence of law
enforcement problems and other natural and manmade conditions which are, or are likely to be,
beyond the control of the services, personnel, equipment, or facilities of the City of Miami ("City")
Department of Police or North Bay Village ("Participating Municipality"); and
WHEREAS, to ensure that preparation of this law enforcement agency will be adequate to
address any and all of these conditions, to protect the public peace and safety and to preserve the
lives and property of the people of the City and the Participating Municipality; and
WHEREAS, the City and the Participating Municipality have the authority under The Mutual
Aid Act, Chapter 23, Part 1, of the Florida Statutes, to enter into mutual aid agreements; and
WHEREAS, the City and the Participating Municipality have the authority under the Florida
Interlocal Cooperation Act of 1969, §163.01 Florida Statutes, to enter into interlocal agreements to
jointly exercise any power, privilege or authority which they share in common and which each might
exercise separately;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute a Mutual Aid Agreement, in
substantially the attached form, between the City and the Participating Municipality, to receive and
extend mutual aid in the form of law enforcement services and resources to ensure public safety and
adequately respond to situations, including, but not limited to, natural or manmade disasters or
emergencies as defined in Chapter 23, Part 1, of the Florida Statutes.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.{2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
