HomeMy WebLinkAboutLegislation FR/SRCity of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00080 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 54/ARTICLE V/SECTION 54-190 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE BUILDING LINES/NONSTANDARD STREET WIDTHS", BY MODIFYING THE WIDTH OF THE NORTH SIDE OF SOUTHEAST 1ST STREET BETWEEN SOUTHEAST 1ST AVENUE AND SOUTHEAST 2ND AVENUE AND SOUTHEAST 2ND AVENUE BETWEEN EAST FLAGLER STREET AND SOUTHEAST 1ST STREET, MIAMI, FLORIDA; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Article V of Chapter 54 of the Code of the City of Miami, Florida, as amended ("City Code"), establishes base building line locations for all public streets within the City of Miami ("City"); and WHEREAS, Southeast 1st Street between Southeast 1st Avenue and Southeast 2nd Avenue and Southeast 2nd Avenue between East Flagler Street and Southeast 1st Street, Miami, Florida, were originally dedicated as 50 foot wide roadways; and WHEREAS, several historic buildings, including the "City National Bank", "Royalton", "Olympia", "Ingraham" and "Walgreen Drug" have been constructed to the original 50 foot roadway right of way line; and WHEREAS, the zoned street width of these roadways were subsequently increased to 75 feet wide and 70 foot wide respectively but the north side of Southeast 1st Street and both sides of Southeast 2nd Avenue have not been dedicated or developed to the 75 foot and 70 foot widths; and WHEREAS, the physical location of the historic buildings preclude roadway widening; and WHEREAS, to continue the protection of the existing historic buildings compatible with new development now being realized in the area, a reduction in the zoned street width to the original dedicated street width along the north side of Southeast 1st Street between Southeast 1st Avenue and Southeast 2nd Avenue and along both sides of Southeast 2nd Avenue between East Flagler Street and Southeast 1st Street, Miami, Florida, is warranted; and WHEREAS, the City Administration's review of these transportation corridors reveal that the current developed roadways adequately serve the vehicular transportation needs of the public and permits the continued protection of the historic buildings; and WHEREAS, the Departments of Police, Fire -Rescue and Solid Waste have evaluated the effect City of Miami Page 1 of 3 File Id: 14-00080 (Version: 1) Printed On: 2/24/2014 File Number: 14-00080 of the reduction of the zoned street width of these roadways on their operations and have no substantial objections; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as fully set forth in this Section. Section 2. Chapter 54/Article V/Section 54-190 of the City Code, entitled "Streets and Sidewalks/Base Building Lines/Nonstandard Street Widths", is amended in the following particulars: {1} "CHAPTER 54 STREETS AND SIDEWALKS * * * * ARTICLE V. BASE BUILDING LINES * Sec. 54-190. Nonstandard street widths. Base building lines shall be located from the centerline as specified for each of the following streets: Streets, Avenues, Roads, Etc., In Alphabetical Order Distance in Feet from Centerline to Base Building Line (3) 1st Street, S.E. and S.W., Biscayne Boulevard to S.W. 1st Avenue 37.5* * Exception - The base building line shall be located 25 feet north of the centerline on the north side of S.E. 1st Street between S.E. 1st Avenue and S.E. 2nd Avenue conditioned on the granting of a 12.5 foot wide perpetual public sidewalk easement in favor of the City of Miami behind the base building line, said easement shall extend to a minimum height of 10 feet above the sidewalk; and providing a sidewalk shall be constructed and maintained by the owner of the property within the easement area, said sidewalk may include Americans with Disabilities Act compliant ramps and steps to transition from the street grade to the building floor elevation. The easement will be in a form acceptable to the Public Works Director and will be recorded in the public records of Miami -Dade County. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective 30 days after final reading and adoption thereof. {2} APPROVED AS TO FORM AND CORRECTNESS: VICTORIA MENDEZ CITY ATTORNEY Footnotes: {1} Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the city Commission.
