A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO ACCEPT A PERPETUAL EASEMENT, IN
SUBSTANTIALLY THE ATTACHED FORM, FROM THE PRIVATE PROPERTY
OWNER, FOR THE CONVEYANCE OF THE PROPERTIES DESCRIBED IN
EXHIBIT "A," ATTACHED AND INCORPORATED, TO THE CITY OF MIAMI FOR THE
PURPOSE OF CONSTRUCTION AND MAINTENANCE OF RIGHT-OF-WAY
IMPROVEMENTS IN ACCORDANCE WITH THE MIAMI RIVER GREENWAY
MASTER PLAN, IN CONJUNCTION WITH THE MIAMI RIVER GREENWAY- MIAMI
CIRCLE GREENWAY TO SOUTH MIAMI AVENUE PROJECT, B-30631.
WHEREAS, a perpetual easement is required from the private property owner of the abutting
properties whose street addresses are 431 and 451 South Miami Avenue, Miami, Florida
("Properties"), respectively, as described in the corresponding easement forms found in "Exhibit A",
attached and incorporated, allowing the City of Miami ("City") access and use for the construction and
maintenance of right-of-way improvements; and
WHEREAS, the roadway improvements include roadway widening along Southeast 5th Street,
Miami, Florida, the addition of sidewalks and other roadway beautification enhancements; and
WHEREAS, the City is only paying a nominal cost of Ten ($ 10.00) Dollars for this perpetual
easement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is authorized{1} to accept a Perpetual Easement, in substantially the
attached form, from the private property owner, for the conveyance of the Properties described in
Exhibit "A," attached and incorporated, to the City for the purpose of construction and maintenance of
right-of-way improvements in accordance with the Miami River Greenway Master Plan, in conjunction
with the Miami River Greenway-Miami Circle Greenway to South Miami Avenue Project, B-30631.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
