HomeMy WebLinkAboutR-14-0092City of Miami Legislation Resolution: R-14-0092 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00158 Final Action Date: 3/13/2014 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BYA FOUR -FIFTHS (4/STHS), AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND AUTHORIZING THE PURCHASE, FROM MORPHO TRAK, INC., OF UPGRADES AND MAINTENANCE FOR THE MORPHO TRAK LATENT WORKSTATIONS AND VERIFICATION WORKSTATIONS FOR THE DEPARTMENT OF POLICE, IN AN AMOUNT NOT TO EXCEED $92,000.00 FOR UPGRADES AND ONE (1) YEAR WARRANTY; ALLOCATING FUNDS FROM ACCOUNT CODE 00001.191001.664000; AUTHORIZING SUPPORT AND MAINTENANCE DURING YEARS TWO (2) AND THREE (3), IN THE AMOUNT NOT TO EXCEED $29,590.00; ALLOCATING FUNDS FROM THE VARIOUS SOURCES OF FUNDS OF THE DEPARTMENT OF POLICE, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A PRODUCT SYSTEM AGREEMENT AND MAINTENANCE AND SUPPORT AGREEMENT WITH MORPHO TRAK, INC., IN SUBSTANTIALLY THE ATTACHED FORM, FOR THE TERM INDICATED UNDER EACH RESPECTIVE AGREEMENT, AND TO NEGOTIATE AND EXECUTE ALL OTHER NECESSARY AMENDMENTS, EXTENSIONS, AND MODIFICATIONS TO THESE AGREEMENTS, AFTER CONSULTATION WITH THE CITY ATTORNEY. WHEREAS, the City of Miami ("City") Department of Police is in need of upgrading the existing MorphoTrak Latent Workstations and Verification Workstations; and WHEREAS, the City's Police Department's workstations communicate with the Miami Dade Police Department ("MDPD") Automated Fingerprint Identification System ("AFIS") and in turn the Florida Department of Law Enforcement and the Federal Bureau of Investigation fingerprint and criminal databases; and WHEREAS, due to upgrades made to the MDPD AFIS, the City's Police Department is now required to upgrade its existing workstations so that it may continue to communicate with MDPD's fingerprint database; and WHEREAS, MorphoTrak, Inc. does not have other sales channels, partners or resellers, and the needed upgrades and maintenance can only be procured and implemented directly from MorphoTrak, Inc.; and WHEREAS, issuing a competitive solicitation (Invitation for Bid or Request for Proposals) for the provision of these upgrades and maintenance would not be practical for the City; and City of Miami Page 1 of 2 File Id: 14-00158 (Version: 1) Printed On: 12/21/2017 File Number: 14-00158 Enactment Number: R-14-0092 WHEREAS, Section 18-92(a)(1) of the Code of the City of Miami, Florida, as amended ("City Code"), the Procurement Ordinance, authorizes sole source awards "Where the compatibility of equipment, accessories, or replacement parts permits one reasonable source of supply"; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. By a four -fifths (4/5ths), affirmative vote, pursuant to Section 18-92 of the City Code, after an advertised public hearing, the City Manager's finding of a sole source, is ratified, approved and confirmed, the requirements for competitive sealed bidding procedures are waived, and the purchase from MorphoTrak, Inc., of upgrades and maintenance for the MorphoTrak Latent Workstations and Verification Workstations, for the Department of Police, is authorized, with funds allocated in the amount not to exceed $92,000.00, for upgrades and one (1) year warranty, from Account Code No. 00001.191001.664000 and in the amount not to exceed $25,590.00, for support and maintenance during years two (2) and three (3) from the various sources of funds of the Department of Police, subject to the availability of funds and the budgetary approval and the time of need. Section 3. The City Manager is authorized {1} to execute a Product System Agreement and Maintenance and Support Agreement with Morph°Trak, Inc., in substantially the attached form, for the term indicated under each respective agreement, and to negotiate and execute all other necessary amendments, extensions, and modifications to these agreements, after consultation with the City Attorney. Section 4. This Resolution shall become effective immediately upon its adoption and the signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
